WHEREAS, the Public Utilities Department (PUD), of the City is badly in need of cash for payment of an overdue account with the National Power Corporation (NPC);

WHEREAS, in the interest of public service, the body deems it proper to pass an ordinance adopting the scheme recommended by Dr. Julie U. Reyes, PUD General Manager;

NOW, THEREFORE, on motion of Councilor Anselmo A. Aquino, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to enact the following Ordinance:

ORDINANCE NO. 01
(Series of 2004)

AN ORDINANCE ADOPTING THE AMNESTY SCHEME 2004
OF THE PUBLIC UTILITIES DEPARTMENT (PUD)

BE IT ORDAINED BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED, THAT:

SECTION 1. The period for granting amnesty in the payment of penalty for consumer with long overdue power account is from July 19 to August 31, 2004;

SECTION 2. The payment scheme is as follows:

From 1996 Down Penalty is waived
From 1997 – 2003 Penalty is reduced to 1% per month
September 1, 2004 Penalty is automatically reverted to 2% per month

SECTION 3. The pertinent letter request of Hon. James Gordon, Jr., City Mayor dated July 2, 2004, and the Memorandum of Dr. Julie U. Reyes, General Manager of the Public Utilities Department (PUD) dated July 1, 2004 are hereby made as integral parts of this Ordinance.

SECTION 4. This Ordinance shall take effect on July 19, 2004 and in compliance with the required posting in three (3) conspicuous places in the City.
