Call to Order

Acting Presiding Officer Gregorio M. Elane called the session to order at 5:10 o’ clock in the afternoon.


Roll Call

With ten (10) Members and the Acting Presiding Officer present, a quorum was declared.


Reading and Adoption of Minutes

On motion of Councilor Rolen C. Paulino, the body adopted the minutes of its Regular Session held last April 14, 2004.


Communications and Referrals of Business

First Reading:

1. Draft Resolution No. 2004-R-34 – A Resolution Authorizing The City Mayor And The City Treasurer To Transact And Negotiate With HYCO Industrial Sales Corp. For The Direct Purchase And Installation Of Escalators In The Olongapo City Mall At Lot 21. Sponsored by Councilor Noel Y. Atienza.

2. Draft Ordinance No. 2004-O-15 – An Ordinance Amending Section 85, Paragraph E Of Ordinance No. 81, Series of 2002 Otherwise Known As “Ordinance Providing For The Olongapo City Revenue Code 2002.” Sponsored by Councilor Gregorio A. Manglicmot.

Communications Read:

1. Memorandum from Messrs. Fermin A. Elago, Jr. and Jose M. Ramos, Consultants, Traffic Enforcement Unit addressed to Hon. Cynthia G. Cajudo, City Vice-Mayor, requesting for additional appropriation in the amount of PhP117,032.00 per month for the account managing traffic services and an addendum to the existing contract with OCWGSMPC. (Referred to the Committee on Public Utilities)

2. An open letter to Mr. Graham Fairlough and Management of Subic Water and Sewerage Company pertaining to the water rate increase in the City of Olongapo. (Referred to Councilors Rexy Gregorio Cruz and Gregorio M. Elane)

3. Quarterly Report on the Real Property Assessments as of quarter ending March 2004 forwarded by Oscar DG. Agustin, City Assessor. (For file)

4. Letter from Isidro P. Lorenzo, Jr., General Manager, OSCSMTSMPCI to the City Mayor thru Hon. Teodoro D. del Rosario, Chairman, Committee on Transportation writing on behalf of the Members of the transport group informing that the Members agreed and decided not to pay the federation fee being collected by the Federation of Transport Services in Olongapo City. (Referred to the Committee on Transportation)

5. Letter from Al Marquez, Site Acquisition Executive MOHAVE Consultancy, Inc. to the City Vice-Mayor requesting to grant a resolution allowing and granting the construction, installation and operation of a DIGETEL’s Cellular Site at the property of Mrs. Adamos located at Brgy. Lower Kalaklan. (Referred to the Committees on Laws & Public Utilities, Treasurer’s Office and Engineering Department)

6. Schedule of activities for Sibit-Sibit Festival from the Olongapo Tourism Office on April 29, 30 and May 1, 2004 at 9:00 a.m.

7. Annual Budget of Barangay Mabayuan for Calendar Year 2004. (Referred to the Committee on Ways & Means)


Committee Report

Councilor Manglicmot reported on the tax relief request of Mr. Jose Lee for non-payment of penalties on his properties located at No. 31, 21st Street, West Bajac-Bajac. He said the matter has been referred to the City Treasurer and the latter in his letter dated April 28, 2004 states that the request of Mr. Lee cannot be granted because in granting tax relief should benefit all taxpayers whose real property taxes are delinquent pursuant to the Local Government Code. He added, that the said matter should be referred to the Committee on Laws for further study.

He also reported on the letter of Mr. Emanual Ramos, OIC, Business Permit Division on the proposed business tax bracket expansion as imposed under Sec. 85 (e) of the City Revenue Code which according to the City Treasurer is in accordance with the Local Government Code.

Lastly, he informed his colleagues that the annual budget of Barangay Mabayuan is still on his committee for further study.

Councilor Paulino informed everyone that he went with the Olongapo team to Rizal Racket Club in Pasig City wherein Patrick John Tierro, the nephew of the late Councilor Remigio Tierro won his match against his opponent from Hongkong.

The following items were considered by the body as urgent matters and were unanimously approved on first, second and final readings:

1. Draft Resolution No. 2004-R-34 – A Resolution Authorizing The City Mayor And The City Treasurer To Transact And Negotiate With HYCO Industrial Sales Corp. For The Direct Purchase And Installation Of Escalators In The Olongapo City Mall At Lot 21. Sponsored by Councilor Edwin J. Piano.

2. Draft Resolution Congratulating Patrick John Tierro For Being One Of The Members Of The Philippine Team Who Will Represent The Country In The Prestigious Davis Cup, An International Tennis Tournament. Sponsored by Councilor Rolen C. Paulino.

There being no further business to be discussed, the session was adjourned at 5:35 in the afternoon.
