Call to Order

On motion of Councilor Aquino, the body appointed Councilor Noel Y. Atienza as Temporary Presiding Officer for today’s Regular Session.

Councilor Marey Beth D. Marzan moved for the suspension of Section 9 of the Internal Rules which states that the Sangguniang Panlungsod’s regular session is every Wednesday and further moved that today’s session be considered as regular session in lieu of tomorrow’s session. Seconded by Councilor Aquino, the motion was carried.

The Temporary Presiding Officer Noel Y. Atienza, called the session to order at 2:20 in the afternoon.

First Reading:

1. Draft Resolution No. 2004 – R-42 – A Resolution Enjoining Everyone To Support The National Celebration Of The Elderly Week From October 1-7, 2004 With The Theme “Nakatatanda – Haligi At Yaman Ng Kulturang Pilipino.” Sponsored By Councilor Angelina B. Andrada

2. Draft Resolution No. 2004 – R-43 – A Resolution Authorizing The City Mayor James Gordon, Jr., To Enter Into A Deed Of Donation With The Boys Town And Girls Home Management Regarding The Installation/Fabrication Of Aluminum Screen Door And Windows, Ma. Clara Building, Boystown Compound, Barangay New Cabalan In The Amount Of PhP32,447.25. Sponsored By Councilor Cynthia G. Cajudo

5. Copy of letters from Dr. Julie Reyes, PUD, to wit:

a. Letter to Mr. Roland S. Quilala, Senior Vice President, Corporate Services, National Power Corporation, Diliman, Quezon City requesting for reconsideration and proposed a new payment arrangement for the balance of the city’s July 2004 Power Bill in the amount of P6,597,770.00 as follows: (Referred to Councilor Aquino)

The city was not able to fulfill its previous commitment in August 24, 2004 letter because Olongapo City has been badly affected by the recent typhoons and the collections the city are expecting did not materialized according to Dr. Reyes.

b. Letter to Roland Quilala, Senior Vice President, NAPOCOR referring to the NPC bill of PUD for the period July 26 to August 25, 2004 in the amount of P35,715,246.80 due and payable on September 24, 2004. The city cannot pay the said amount on the due date because of a serious cash flow problem worsen by the recent typhoons that affected the city very badly. (Referred to Councilor Aquino)

The 16% penalty per annum on the unpaid balance will be added in the city’s payment.

c. Letter to Mr. Fernando S. Abesamis, Asst. Vice President, National Transmission Corporation, North Luzon Operations & Maintenance, San Fernando City, La Union referring to the bill of the PUD for the period July 26 to August 25, 2004 from the National Transmission Corporation in the amount of P10,332,577.43 which is due and payable on September 24, 2004. The city cannot pay the said amount in full on the said due date because of the cash flow problem the city is experiencing at present. Olongapo City has been badly affected by the recent typhoons so that the much needed collection from the consumers did not materialize.

Dr. Reyes is hereby requesting that PUD be allowed to settle the city’s account under the following payment arrangement schedule: (Referred to Councilor Aquino)

Committee Reports

Councilor Marzan gave the background of the Children’s Month Celebration this year. Usually the said event is headed by the DSWD together with non-government and other private organizations. This year, the Council for the Protection of Children and the Department of Education submitted their recommendations and activities for the month -long celebration. For this, the Councilor moved for the adoption of a Resolution enjoining all sectors in Olongapo City to support the Children’s Month, to properly document the City’s stand on children’s welfare and development.

Draft Resolution No. 2004-R-39 – A Resolution Adopting The Decision Dated September 21, 2004 Of The Committee On Laws, Complaints Investigation & Human Rights Protection Recommending That Barangay Resolution 016, Series of 2004 Be Declared Null And Void And Further Recommending That Barangay Captain Rolando Apalit Be Suspended From The Performance Of His Official Function As Barangay Captain Of Barangay Asinan, Olongapo City For A Period Of Two (2) Months From Receipt Thereof. B. The body discussed items for possible amendment to the Internal Rules of Procedure of the Sangguniang Panlungsod of the City such as urgency of the measure, signature of each councilor in some resolutions which will not in anyway prejudice public interest among others.

The Chairman requested the Councilors to submit their proposed amendments for further study. However, the said rules could only be amended after six months and upon the majority vote.
