In the interest of public service and on motion of Councilor Cynthia G. Cajudo, co-sponsored by Councilors Teodoro D. del Rosario and Brian Patrick H. Gordon, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to enact the following Ordinance:


ORDINANCE NO. 11
(Series of 2005)

AN ORDINANCE DECLARING PORTION OF THE MAIN THOROUGHFARE
(PRIMARY STREETS) AND SIDE STREETS (SECONDARY STREETS) AS
PAY PARKING AREAS IN THE CITY OF OLONGAPO


BE IT ORDAINED, BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED, THAT:

SECTION 1. All city streets in the City of Olongapo with a width of six (6) meters and with set back for sidewalk is hereby declared as pay parking area. Excluding areas which are six (6) meters from an intersection or corner and other areas which by law or ordinance is declared prohibited for parking roads used as alternate route for public utility vehicles such as Brill and Anonas Streets (West Bajac-Bajac) Corpuz Street (West Tapinac).

The following main thoroughfare shall be declared as pay parking areas:

a. Left Side of Magsaysay Drive facing main gate of SBMA from Volunteers traffic circle to Gordon Avenue.

b. Both Sides of Rizal Avenue from Volunteers traffic circle to three (3) meters before the corner cast and west 1st street.

c. Left Side of Rizal Avenue facing south from Volunteers circle to Ulo ng Apo traffic circle.

d. Left Side of 19th Street (National Highway) from Ulo ng Apo circle towards Mabayuan Bridge.

e. Left Side of Rizal Avenue from 19th Street to 27th facing south.

SECTION 2. The City Barangay Councils and the office of the City Engineer shall identify these streets within their jurisdiction.

SECTION 3. There shall be only one side parking left side facing the streets of Rizal Avenue, Magsaysay Drive, Gordon Avenue and Otero avenue, Acacia, Waterdam Longroad, F. Manalo Highway, Rizal Street (Bo. Barretto) Filtration Street, Sta. Rita and other main streets of each barangay.

SECTION 4. All access to driveways shall remain free and accessible and should not be blocked to include jeepneys stops for loading and unloading and fire lanes.

SECTION 5. The City Engineering Office shall paint markings in the following manner and designation:

a. Loading and Unloading Area - shall have lines to accommodate five (5) vehicles at a time.

b. Pay Parking Area – white painted gutter with wording pay parking only

c. No Parking Area – yellow painted gutter with wording no parking

d. Fire lane – red painted gutter with the working fire lane

It shall be the duty of the City Engineering Office to construct and display adequate signage's for the education of the public especially upon entrance of the city at Cabalan and Kalaklan Highways

The city through the traffic board shall conduct public information drive to inform and educate the public on a regular basis to the implementation of this Ordinance.

SECTION 6. All residents of Olongapo who owns a motor vehicle may apply for an annual parking sticker at the office of the business permit section. The office shall require submission of the following documents to ascertain ownership of vehicle and address of the owner:

a. Copy of the original official receipt and certificate of registration of the motor vehicle.

b. A barangay certificate ascertaining the exact residence of the owner.

SECTION 7. The business permit section after processing shall advice thru a bill to be paid to the City Treasury Office the amount hereby set:

a. 2 to 3 wheeled motor vehicle peso per day – PhP365 per annum or equivalent to PhP1.00 per day

b. Car, vans and jeeps – PhP730 per annum or equivalent to PhP2.00 per day

c. Trucks/busses (up to 6 wheeler only) – PhP1,460.00 per annum or equivalent to PhP4.00 per day

SECTION 8. The official receipt issued by the office of the City Treasurer shall be the proof for the issue of an annual parking sticker. There shall be a proper log of this issued sticker. The renewal of this sticker shall be yearly based on the ending number of the vehicles registration plate of the vehicle. The following schedule is to observe.


January - Ending 1 July - Ending 7
February - Ending 2 August - Ending 8
March - Ending 3 September – Ending 9
April – Ending 4 October – Ending 0
May - Ending 5 November – Ending 0
June - Ending 6 December – Ending 0

SECTION 9. The sticker shall be placed on the right side of the front windshield of a vehicle. All vehicles with an updated sticker shall not be charged by the parking attendant and shall be free from using the designated parking area on first come first serve basis.

SECTION 10. All vehicles which has no parking stickers shall be approached to pay parking ticket by parking attendants thirty (PhP30.00) per day.

SECTION 11.

a. Vehicles which are abandoned and unattended without sticker shall be subject to be towed by authorized towing agency of the city.

b. This shall be impounded in the city impounding area designated by the City Mayor.

c. Release of impounded vehicles is subject to payment of impounding fee based on Ordinance No. 37, Series of 1998.

d. Towing shall be guided by Ordinance No. 97, Series of 1999.

e. Unclaimed vehicles after sixty (60) days shall be subject to public auction.

The Office of the City Treasurer in coordination with the Office of the City Mayor shall initiate and submit the guidelines to the Sangguniang Panlungsod for approval before implementation of the same.

SECTION 12. Prohibited to Park. All private vehicles, equipments which are heavy beyond truck or bus capacity are prohibited to occupy space in the designated parking areas. Violation of this rule shall subject the owner from paying a fine of:

1st Offense - PhP1,000.00
2nd Offense - PhP3,000.00
3rd Offense - PhP5,000.00 and filing of applicable charges in the City Court of Olongapo.

The vehicle or equipment found in violation of this Ordinance shall be impounded and towed to the city impounding area at the expense of the owner. The following impounding fee shall be charged under Section 4 of Ordinance No. 37, Series of 1998.

Unclaimed within sixty (60) days shall be subject to public auction with the same provision of Section 1E of Ordinance No. 97, Series of 1999.

SECTION 13. Business establishments may avail of parking areas opposite their place of business upon application of annual parking sticker to be displayed by their customers on their parked vehicle. Such priority shall only be for the space limited to 1 to 2 vehicles within 30% of available space.

SECTION 14. There shall be no double parking.

SECTION 15. There is hereby created under the office of Business Permit parking attendants who shall monitor, issue and collect parking tickets. The office may also recommend if not feasible the management of a contractor or contractors regarding the implementation of this ordinance subject to the approval of the City Mayor and the City Council.

SECTION 16. The Office of the Traffic Management shall issue citation tickets to erring drivers found in violation of this Ordinance. They shall assist the accredited parking attendants in the implementation of this Ordinance.

SECTION 17. Penalties. Person or persons found in violation of part or parts of this ordinance shall be fined in accordance to the traffic citation system of the city.

1st Offense - PhP300.00
2nd Offense - PhP500.00
3rd Offense - PhP1,000.00 or imprisonment of not more than 2 days upon the discretion of the Court.

SECTION 18. All funds accruing to this Ordinance shall be deposited in a trust fund for the purpose of improvement and development of a public parking area in the city.

SECTION 19. Expenses needed for the implementation of this Ordinance in its initial period shall be charged from any available funds of the city with the traffic citation.

SECTION 20. Any part or parts of this ordinance inconsistent with any previous ordinance shall prevail and consider the former as modified repealed or amended.

SECTION 21. Any part of this Ordinance which may violate any law or constitution shall not render the other parts of this Ordinance in effect after its approval.

SECTION 22. This ordinance shall take effect upon the approval of the City Council and after complying with legal requirements of a public hearing.
