RESOLUTION NO. 69
(Series of 2005)

A RESOLUTION AUTHORIZING LEOPOLDO “MIKE” PUSING TO REPRESENT THE CITY OF OLONGAPO IN THE CIVIL AND CRIMINAL CASES TO BE FILED AGAINST PR LPG COMPANY AND CARLOS JALAJADO


WHEREAS, ON June 5, 2005 at around twelve o’clock (12:00) midnight a vehicular accident happened at the National Highway, Purok I, New Cabalan, Olongapo City ;

WHEREAS, the vehicular accident was caused by a wayward LPG truck with plate number NUW 378, driven by a person named CARLOS JALAJADO and owned by PR LPG COMPANY;

WHEREAS, the vehicular accident, due to the reckless imprudence of the driver and the failure of PR LPG COMPANY to exercise extraordinary diligence in the selection, supervision and discipline of its driver, caused damages to the City of Olongapo and some of its constituents;

WHEREAS, as a consequence and to protect its interest, the City deems it necessary to file civil and criminal cases against PR LPG COMPANY and its driver CARLOS JALAJADO;

WHEREAS, these civil and criminal cases to be filed against PR LPG COMPANY and CARLOS JALAJADO shall require a duly authorized representative from the City;

NOW THEREFORE, with the unanimous accord of the Members of the Sanggunian Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to authorize, as it hereby authorizes LEOPOLDO “MIKE” PUSING, to represent the City of Olongapo in all stages/phases of the civil and criminal cases to be filed against PR LPG COMPANY and CARLOS JALAJADO;

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, that LEOPOLDO “MIKE” PUSING, is hereby authorized to appear for and on behalf of the City of Olongapo during the PRE-TRIAL of the pertinent civil case, including the power to enter into the possibility of an amicable settlement or of a submission to alternative modes of dispute resolution; the possibility of obtaining stipulations or admissions of facts and of documents to avoid unnecessary proof; and such other powers as required under Rule 18 of the Revised Rules of Civil Procedure.
