ORDINANCE NO. 03
(Series of 2004)

AN ORDINANCE AMENDING ORDINANCE NO. 81 SERIES OF 1999 BY FIXING THE TRANSPORTATION FARE FOR MOTORIZED TRICYCLES IN OLONGAPO CITY AND FOR OTHER PURPOSES

BE IT ORDAINED, BY THE SANGUNIANG PANLUNGSOD IN SESSION ASSEMBLED, THAT:

SECTION 1. Ordinance No. 81, Series of 1999 is hereby amended to fix the passenger transportation fare for motorized tricycles in Olongapo City to wit:

a. The official fare rate for motorized tricycles for hire in Olongapo City shall be: Five Pesos (PhP 5.00) per passenger each zone: Provided, however, that the amount of Ten Pesos (PhP 10.00) shall be paid by the passenger when he rides in a tricycle from its terminal parking line and does not want the driver to wait for a second passenger so that the driver can leave at once; Provided, further, that the amount of Five Pesos (PhP 5.00) shall be paid by the passenger who calls and takes a ride in a tricycle traveling on its zone of operation, i.e., not parked in its terminal parking line.

b. And the same shall be subject to the following terms and conditions:

(1) No operator shall be allowed to avail of the new fare rate unless his unit(s) is duly covered by a franchise/authority issued by the Sangguniang Panlungsod of Olongapo and complied with Section 9 of Ordinance 29 Series of 1992.

(2) All legal operators/drivers of tricycles for hire shall post a notice of the authorized fare rates in a conspicuous place inside the vehicle. A penalty of Five Hundred Pesos (PhP 500.00) shall be imposed on the operator/driver for failure to comply with this provision. Repeated violations shall mean the cancellation of the operator’s franchise after due process.

SECTION 2. Except as provided in Section 1 b (2) above, violations of this Ordinance shall be subject to penalties as specified in Ordinance No. 3, Series of 1990.

SECTION 3. Copies of this Ordinance shall be furnished the City Court, City Fiscal, City Chief of Police, Barangay Captains, Tricycle Associations, Land Transportation Officer and Traffic Division Chief for their information and guidance.

SECTION 4. This Ordinance shall take effect upon its approval.
