RESOLUTION NO. 70
(Series of 2005)

A RESOLUTION AUTHORIZING MR. MERLITO J. MAJARUCON, DEPARTMENT HEAD OF THE GENERAL SERVICES OFFICE (GSO), TO REPRESENT THE CITY OF OLONGAPO IN THE CIVIL AND CRIMINAL CASES TO BE FILED AGAINST ENGINEERS REYMUNDO GUEVARRA
AND CONSTANTE FARIN


WHEREAS, an administrative case entitled “CITY OF OLONGAPO vs. Reymundo Guevarra and Constante Farin” docketed as Admin. Case No. 8-05, has been filed, investigated and terminated, in connection with the stolen articles owned by the City, such as metal water tanks and iron fences, from the Engineering Motor Pool, TRANSCON Compound, Old Cabalan, Olongapo City;

WHEREAS, Engineers Reymundo Guevarra and Constante Farin as a result of said administrative investigation, were DISMISSED from government service effective May 16, 2005;

WHEREAS, as a consequence and to protect its interest, the City deems it necessary to file civil and criminal cases against Engineers Reymundo Guevarra and Constante Farin, mindful of the doctrine that public office is a public trust, and therefore, probity and accountability should be the paramount consideration for service;

WHEREAS, these civil and criminal cases to be filed against Engineers Reymundo Guevarra and Constante Farin shall require a duly authorized representative from the City;

NOW, THEREFORE, on motion of Councilor Cynthia G. Cajudo,with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to authorize, as it hereby authorizes MR. MERLITO J. MAJARUCON, Department Head of the General Services Office (GSO), to represent the City of Olongapo in all stages/phases of the civil and criminal cases to be filed against Engineers Reymundo Guevarra and Constante Farin;

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, that the GENERAL SERVICES OFFICE (GSO) through its DEPARTMENT HEAD, MERLITO J. MAJARUCON, is hereby authorized to appear for and on behalf of the City of Olongapo during the PRE-TRIAL of the pertinent civil case, including the power to enter into the possibility of an amicable settlement or of a submission to alternate modes of dispute resolution; the possibility of obtaining stipulations or admissions of facts and of documents to avoid unnecessary proof; and such other powers as required under Rule 18 of the Revised Rules of Civil Procedures.
