Call to Order

On motion of Councilor Aquino, the body appointed Councilor Noel Y. Atienza as Temporary Presiding Officer for today’s Regular Session.

Councilor Marey Beth D. Marzan moved for the suspension of Section 9 of the Internal Rules which states that the Sangguniang Panlungsod’s regular session is every Wednesday and further moved that today’s session be considered as regular session in lieu of tomorrow’s session. Seconded by Councilor Aquino, the motion was carried.

The Temporary Presiding Officer Noel Y. Atienza, called the session to order at 2:20 in the afternoon.

The city was not able to fulfill its previous commitment in August 24, 2004 letter because Olongapo City has been badly affected by the recent typhoons and the collections the city are expecting did not materialized according to Dr. Reyes.

Letter to Roland Quilala, Senior Vice President, NAPOCOR referring to the NPC bill of PUD for the period July 26 to August 25, 2004 in the amount of P35,715,246.80 due and payable on September 24, 2004. The city cannot pay the said amount on the due date because of a serious cash flow problem worsen by the recent typhoons that affected the city very badly. (Referred to Councilor Aquino)

The city cannot pay the said amount in full on the said due date because of the cash flow problem the city is experiencing at present. Olongapo City has been badly affected by the recent typhoons so that the much needed collection from the consumers did not materialize.

Committee Reports

Councilor Marzan gave the background of the Children’s Month Celebration this year. Usually the said event is headed by the DSWD together with non-government and other private organizations. This year, the Council for the Protection of Children and the Department of Education submitted their recommendations and activities for the month -long celebration. For this, the Councilor moved for the adoption of a Resolution enjoining all sectors in Olongapo City to support the Children’s Month, to properly document the City’s stand on children’s welfare and development.

The Chairman requested the Councilors to submit their proposed amendments for further study. However, the said rules could only be amended after six months and upon the majority vote.

Committee Reports

Councilor Atienza informed the body that Brgy. Capt. Danilo Fernandez assumed his former position already as of Sept. 19, 2004. In connection with another case, the Councilor requested his colleagues to attend the hearing on Tuesday regarding the case filed by the Lupong Tagapamayapa against the aforesaid Barangay Captain at 9:00 a.m. The parties’ presentation of the witnesses as well as their documentary exhibits will be asked to facilitate the resolution of the case. The Councilor made note that the presence of the Councilors is of high importance as previously stressed by Councilor Cajudo.

Councilor del Rosario gave the highlights of the meeting of Mayor Bong Gordon with the Olongapo City Musicians Association and the possible participation of the latter in the opening of the Mardi Gras. The said musicians, even those who are inactive in the business, were encouraged to participate as volunteers to the brass band or the City’s upcoming band or orchestra formation. The said musicians also aired their sentiments that during Mardi Gras, Manila bands or bands from different provinces get the bookings. For this reason, the sponsors were furnished the list of bands in the City and what type of music they play so that they can be booked soon. This action made the musicians glad that once again their group will be organized, the Councilor said.

In this note, Councilor del Rosario announced that the Mardi Gras is already set on Oct. 29, 30, 31. The said affair dubbed as Mardi Gras Reborn is free of charge and presents a line up of at least 29 events such as paint ball, art exhibit, henna tattoo, Mardi Gay, Little Mr. and Ms. Olongapo, BMX and skateboard presentation and others. Information drive about the said event which was spearheaded by different youth organizations like the Demolay had already been conducted to inform the business community all over the City.

As part of the fiesta event, the Councilor also relayed that the First Canvassing for the Olongapo City Fiesta Queen Contest will be held at the Olongapo City Convention Center under the theme “Cocktail Night”. Series of meetings with the participants, barangays and businessmen had already been transpired, he said. The Councilor also reminded everyone that the Executive Committee as well as the Members of the Standing Committees will hold a meeting at 10:00 a.m. the following morning at the Session Hall.

On another item, Councilor del Rosario reported the highlights of the regular meeting of the Olongapo City Local Price Coordinating Council such as the saturation drive at the West Bajac-Bajac Flea Market and the apprehension of vendors with defective and unregistered weighing scales where 68 had been caught and penalized. Saturation drives were scheduled on markets as well as in school canteens to ensure the safety of school children.

Also, the Councilor shared that in preparation to the opening of Consumer Welfare Month this October, he recommended that the item on second reading regarding the City Wide Sale, particularly on the City’s request to the DTI to waive the permit for sale promotion be passed. This measure will encourage business establishments to participate into the said activity which will coincide in the opening of the Mardi Gras on Oct. 29, 30 & 31.

The Vice Mayor and Presiding Officer also instructed Councilor del Rosario to prepare a letter addressed to the Manila Sports Car Club, to invite them to participate in the upcoming Mardi Gras without cost on our part. All they want is to display their 1950, 1940 and 1960 editions at the Magsaysay Drive. They were already informed about the said affair, he said.

Also, the Vice Mayor inquired if there are standing penalties for owners with defective weighing scales.

Councilor del Rosario clarified that there is a corresponding fine for the said offense and that the defective weighing scale is destroyed afterwards. Those also who use fraudulent acts in vending, such as the use of red light to make the fish, pork or chicken look fresh and other similar acts will also be penalized. In addition to this, the LPCC also discovered that those who sell sago and gulaman use a chemical known as “magic sugar” in place of the real sugar. It was discovered that it contains compounds that can cause cancer. This is also one of the reasons why the LPCC is conducting its saturation drives.

Councilor Aquino gave an update on the verbal instruction given to him by the Vice Mayor to inspect the drainage canal, somewhere in Sta. Rita, Tabacuhan, Cayabyab and Cristobal Streets.

He said that he inspected the said drainage last Sept. 17 and found out that the drainage canal is indeed clogged. He asked the assistance of the Engineering Office and requested them to conduct an estimate on the drainage works/repair that shall be done to resolve the said concern. The Councilor also deemed that appropriation of funds is necessary for the said drainage works.

The Vice Mayor and Presiding Officer thanked the Councilor and even showed his report with matching sketches of the would-be drainage works at Cristobal Street.

Councilor Cajudo gave an account on the following matters discussed during the caucus attended by Councilors Perez, Asuncion, Andrada, del Rosario, Aquino and Marzan together with the City Accountant, Mall Administrator, Fifi Legaspi and Mr.Ernie Hernandez from the Mayor’s Office and Ms. Josie Nieves of the Budget Department:

1. Resolution from Naga City regarding IRA cutback
2. Terminal leaves of barangay officials of Old Cabalan
3. The indorsement of Priority Projects 2003 as well as the budget for the Mall.
4. Transfer of Trust Fund accounts to the General Fund
5. The City’s bid for the Jaycee’s National Convention and request for Appropriation by the Office of the City Mayor amounting to P70,000.00.

Councilor Andrada relayed to the body that the City Health Department conducted a free medical and dental clinic at IRAM last Sept. 16 and at Kalalake last Sept. 17. Four Hundred Three (403) patients were attended to at IRAM and 308 at Kalalake.

On another item, Councilor Andrada reported that the UP College of Public Health and the Department of Health jointly conducted a parasitologic survey of soil transmitted helminthiasis in all regions of the Philippines among children aged one to five years old. The objective is to generate an adequate epidemiologic and environmental data on the prevalence of this disease. The said study aims to assess the gravity of the worm disease in children in a community and to disseminate information regarding the said disease as well as its environmental and sanitation aspects. The pilot area for the said research is in Banicain and an orientation seminar regarding it was conducted on September 21. The actual start of the stool examination will be on September 28 and all those found positive shall be given deworming medications by the Department of Health, she said.

When asked by the Presiding Officer regarding the cases of sore eyes in the city, Councilor Andrada replied that the number of cases are dropping, but they are continually distributing fliers in the barangays and public markets regarding this. She was even asked by Councilor Atienza on the best medication for children with sore eyes. The Physician Councilor answered that it is Terramycin Ophthalmic Ointment.

Councilor Marzan updated her colleagues on the organization of student councils in the Elementary and High School in coordination with the Department of Education. The members of the said councils will comprise the Youth Development Board, where the creation thereof had been recently passed as an ordinance. Through the Department of Education the said Federation of Elementary and High School students had already conducted their leadership training. The federation from the College Department will soon be organized.

The Councilor also shared that when she attended the meeting of the ALCU, its officers expressed their gratefulness to the City Council for coming up with the Resolution of Appreciation to them. They even stressed that it is the first in the history of ALCU that a member-institution had done such. Our membership with ALCU provided us with assistance in the drafting/creation of policies and guidelines as well as the resolution of our concerns regarding CHED accreditation.

With regard to the City Museum and City Library, an amendment shall soon be presented to improve its operations as had been reported in the previous session. Miss Sharon Alba had already submitted the staff definition and scope under the City Museum which will soon be under the Committee on Education, Councilor Marzan said.

The Vice-Mayor and Presiding Officer reminded Councilor Marzan regarding the number of scholars at the Gordon College as well as the requirements for scholarship.

Councilor Perez recounted that the Committee on Organizational Development and Personnel Matters, which pursues its thrust to strengthen the Civil Service in the Local Government and boost the professional development of all employees, came up with activities like seminar and trainings for the professional development of employees of the City. Recently, the Councilor found out that we have only P100,000.00 funds for training and such is insufficient to cover the whole year training requirement. For this, she recommended for a set of in-house seminars and enjoined the Councilors if they themselves would like to impart their knowledge on a certain topic in line with the activities for 2005. She also said that if we know of somebody who can speak for a 3-4 hour-seminar without so much cost on our part will indeed be beneficial.

Councilor Piano apprised the body on the meeting of the Task Force on Mass Land Titling created by Mayor Bong Gordon through Executive Order 31.

The said meeting was presided by Mr. Jimmy Mendoza, task force head with Councilor Noli Capistrano, of the ABC, and Marcelino Andawi, City Treasurer, Oscar Agustin, City Assessor, Engr. Rey Guevarra, City Engineer, Ms. Joan Agaton from the City Planning and Development Office, Mr. Vic Biscocho, PR Consultant of the group and Atty. Raymond Dilag. Among the matters discussed were the possible incentives to land titling applicants and the conduct of massive information campaign to ensure the project’s success.

Councilor Piano also reported that a 2-day cellphone troubleshooting and repair training for 104 technicians in Olongapo had been conducted at the COMPTECH Computer and Business College. This training was sponsored by the Technical Education and Skills Development Authority with Mr. German Ebue, Telecommunications Consultant and Mr. Leonardo Perez who shared their expertise.

After the 2-day training, a competency assessment and licensing were conducted. It was noted that many cellphone technicians exceeded their expectation with their competence. For this, the city can be assured of qualified and certified technicians who use advance technology for their repair work.

In line with the said training and certification, a Mobile Registration spearheaded by the National Telecommunications Commission was held the following day at the Convention Center. All cellphone dealers and technicians, repair center operators are all invited to go to the Convention Center to register. This was done so that the said dealers and technicians need not go to the National or Regional Office to secure their permits to operate. They are also inviting owners of 2-way radios if they would like to secure their RLM, or seminar for the use of radio and if they register their units that day, their base radio will be likewise accepted.

When asked by the Vice Mayor if there will be conflict with SBMA regarding the licensing of radios, the Councilor answered that according to the MOA between SBMA and NTC, SBMA has also the authority to grant permits to radio operators to those who are located inside the Freeport. Those business outside the Freeport, are no longer under their jurisdiction.

The Vice Mayor also gave instruction to the Council Secretary to furnish Councilors Andrada and Piano copies of the letter sent by the Bureau of Health Devices and Technology regarding the construction of transmitters which may have harmful effects to the health of the community dwellers.

Councilor Cajudo shared to the body that before the said session, she attended the Lakbay-Aral Briefing of the visitors from Infanta, Quezon where the said visitors presented for the City a Certificate of Appreciation. This came from the Federation of Infanta Tricycle Association, Infanta Sangguniang Bayan Committee on Transportation, chaired by Hon. Ricardo Macasaet III, Vice-Mayor and Presiding Officer and Hon. Minette Macasaet De Dios. The said officials are interested to know how the city started and implemented the color-coding of our transport system.

Committee Reports

Councilor Asuncion enumerated the planned activities discussed during the meeting of the Women Council with the NGOs that day, for the Family Week celebration on September 22-28, 2004. it will be launched on the Flag Raising Ceremony on Sept. 20, 2004 with this year’s theme: “Building Families of Character for a Strong Republic” to promote awareness among city government officials and employees. The weekly activities consist of the following: hanging of streamers on business establishments assigned to the City Health Department; free clinic on Sept. 17, 2004 from 8:00 a.m.-12:00 noon at the San Lorenzo Ruiz Parish Church to be led by Dr. Molina of Kalalake Brgy. Health Center; mass offering on Sept. 19 or 22; school symposium at OCNHS on Sept. 21 at 2:00 p.m. and breast examination in all barangay health centers will be conducted for the whole week. Furthermore, the CSWDO will also hold a Family Day at the Social Development Center on Sept. 24 at 1:00 p.m and came up with a project entitled “Adopt a Family” from Sept. 22-28, 2004. To take part are the BSP and GSP which will hold a whole day activity at Anne Raquel’s Mt. Resort on Sept. 24, 2004 and the Soroptimist and Ventures Club will have a fun day/sportsfest on Sept. 25, 2004 at the Rizal Triangle.

Councilor Andrada reported that the City Health Department conducted a training seminar for barangay health workers last Sept. 14 in preparation for the launching of the Botika ng Barangay. This project of the Department of Health aims to provide the people in the community access to cheaper and more affordable medicines in their own communities instead of going to the City proper where most of the drugstores are located. Five (5) barangays were identified to operate the Botika ng Barangay consisting of Barangays Gordon Heights, Old Cabalan, New Cabalan, Barretto and Sta. Rita. Each barangay will be given a seed capital of P25,000 worth of medicines to sustain the project and shall be manned by the barangay health workers of the aforesaid areas.

Councilor Atienza made note on the matters referred to his committee. First is with regard to revocation of the Memorandum of Agreement made and executed by and between Barangay East Bajac-Bajac and the Olongapo Tipo Transport Service Cooperative, Inc. contained in the minutes of the regular session of East Bajac-Bajac Barangay Council forwarded to him. He said that he had instructed his staff to request the EBB Brgy. Capt. to furnish him a copy of the said MOA. He also recommended to the august body to conduct an investigation regarding the alleged complaint of residents within the vicinity of the terminal because it came to his knowledge that there was a barricading incident related to it. He also would like to request the presence of Councilors Cajudo, Piano and Andrada in the conduct of the investigation to check into the health concerns raised by residents near the said terminal.

Second, Councilor Atienza shared to the body the status of the cases/notes referred to him as Chairman of the Committee on Complaints and Investigation, to wit:

(1) The case of Edgardo Danugrao, et al vs. Danilo Fernandez for grave abuse of authority and misconduct. A committee hearing was conducted for the said case where the following showed up:

Acting Barangay Capt. Edgardo Danugrao, respondent Danilo Fernandez, the Treasurer Mary Jane Casillano and the members of the Lupon Tagapamayapa, who filed a complaint alleging that they have not received their honorarium for the months of April-June 2003, namely: Loida Napalan, Conchita Ela and Merope Tala. In the preliminary hearing, the parties failed to arrive into an amicable settlement. As part of the procedure, Councilor Atienza required the respondent Danilo Fernandez to submit a counter affidavit on the complaint filed by Edgardo Danugrao.

(2) The case of Rodolfo Santos vs. Danilo Fernandez for collection of unpaid rentals. A subpoena had been served for this matter and was attended by Mrs. Santos, wife of Rodolfo Santos and Danilo Fernandez. A compromise agreement was forged by the contending parties and thus, Councilor Atienza shall be recommending the same for dismissal. Further, the jurisdiction of the case belongs to the court and not the Committee on Investigation, he said.

(3) On the complaint filed by four (4) Councilmen of New Cabalan, namely Councilors Columbrites, Pamanila, Arcenal and Grueso against Brgy. Capt. Ubungen, the counter affidavit of the respondent and the joint affidavit filed by the complainants last Sept. 7, 2004 is yet to be received by the committee.

(4) The letter sent by Danilo Fernandez informing the august body that he will be assuming and discharging his duties and obligations as an incumbent Brgy. Captain of Mabayuan effective Sept. 16, 2004. For the record, the Councilor replied that the term of suspension was indeed fixed to a period of 30 days from Aug. 16, 2004 to Sept. 16, 2004, but his resumption to the said office is not automatic. For this, Capt. Fernandez still needs to secure clearance from the DILG as well as from the Mayor’s Office.

Councilor Cajudo inquired if there were already hearings conducted on the aforesaid cases since as a member, she had not attended any.

Councilor Atienza answered that preliminary hearings were conducted since those cases were preliminary in nature and were done to save the time of other councilors. He said that formal hearings will be conducted and all members of the Sangguniang Panlungsod will be invited and be given notices.

For the next committee report, Councilor Marzan notified the body on the upcoming regular board meeting of the Association of Local Colleges and Universities (ALCU) on Sept. 22, 2004. She mentioned that Gordon College’s membership with ALCU enabled the college to avail of various instructional resources including policies and guidelines relative to the operation of the College. Even the Pamantasan ng Lungsod ng Maynila, headed by President Dr. Benjamin Tayabas expressed committed support to develop not only the college but also its personnel through technical assistance and consortional agreement. In this regard, Councilor Marzan recommended the body to pass a resolution expressing appreciation to ALCU and Dr. Tayabas.

When asked by the Presiding Officer on the venue of the Gordon College’s Sportsfest, Councilor Marzan replied that they held the opening program at the Rizal Triangle where the Mr. and Miss Sportsfest and Cheering Squad Competitions were performed. The College of Allied Medical Courses won the cheering squad competition and the other sports events were held at the Rizal Triangle and East Tapinac Oval.

On another report, Councilor Marzan informed the body regarding the operations of the City Library and City Museum which are part of the Committee on Education, Culture and Arts. She mentioned that Ordinance No. 1, Series of 1968 was passed to prescribe the powers and duties of the City Library and Gallery of Art and to promulgate the rules and regulations for the operation thereof. With the creation of the City Museum, the Councilor recommended for the passing of a similar ordinance for the Museum.

For the City Library, Councilor Marzan updated everyone that an event patterned on the “LG Quiz/Competition will be launched to create reading awareness for our youth and the entire citizenry. This thrust of the City Mayor aims to make the youth appreciate the benefits of reading.

To wrap up, the Vice Mayor gave the following reminders and instructions:

(1) For Councilor Andrada to check on the prices of funeral services and study on how to regulate them;

Also, for the Councilor to check on the cases of sore eyes in the City. Councilor Andrada explained that they had been sending out fliers to the barangays since the last week of August. To avoid this, public and personal hygiene should be monitored, she said.

(2) For Councilor Aquino to check on the drainage system at the back of Cristobal St., Barangay Sta. Rita.

Committee Reports

Councilor Asuncion enumerated the planned activities discussed during the meeting of the Women Council with the NGOs that day, for the Family Week celebration on September 22-28, 2004. it will be launched on the Flag Raising Ceremony on Sept. 20, 2004 with this year’s theme: “Building Families of Character for a Strong Republic” to promote awareness among city government officials and employees. The weekly activities consist of the following: hanging of streamers on business establishments assigned to the City Health Department; free clinic on Sept. 17, 2004 from 8:00 a.m.-12:00 noon at the San Lorenzo Ruiz Parish Church to be led by Dr. Molina of Kalalake Brgy. Health Center; mass offering on Sept. 19 or 22; school symposium at OCNHS on Sept. 21 at 2:00 p.m. and breast examination in all barangay health centers will be conducted for the whole week. Furthermore, the CSWDO will also hold a Family Day at the Social Development Center on Sept. 24 at 1:00 p.m and came up with a project entitled “Adopt a Family” from Sept. 22-28, 2004. To take part are the BSP and GSP which will hold a whole day activity at Anne Raquel’s Mt. Resort on Sept. 24, 2004 and the Soroptimist and Ventures Club will have a fun day/sportsfest on Sept. 25, 2004 at the Rizal Triangle.

Councilor Andrada reported that the City Health Department conducted a training seminar for barangay health workers last Sept. 14 in preparation for the launching of the Botika ng Barangay. This project of the Department of Health aims to provide the people in the community access to cheaper and more affordable medicines in their own communities instead of going to the City proper where most of the drugstores are located. Five (5) barangays were identified to operate the Botika ng Barangay consisting of Barangays Gordon Heights, Old Cabalan, New Cabalan, Barretto and Sta. Rita. Each barangay will be given a seed capital of P25,000 worth of medicines to sustain the project and shall be manned by the barangay health workers of the aforesaid areas.

Councilor Atienza made note on the matters referred to his committee. First is with regard to revocation of the Memorandum of Agreement made and executed by and between Barangay East Bajac-Bajac and the Olongapo Tipo Transport Service Cooperative, Inc. contained in the minutes of the regular session of East Bajac-Bajac Barangay Council forwarded to him. He said that he had instructed his staff to request the EBB Brgy. Capt. to furnish him a copy of the said MOA. He also recommended to the august body to conduct an investigation regarding the alleged complaint of residents within the vicinity of the terminal because it came to his knowledge that there was a barricading incident related to it. He also would like to request the presence of Councilors Cajudo, Piano and Andrada in the conduct of the investigation to check into the health concerns raised by residents near the said terminal.

Second, Councilor Atienza shared to the body the status of the cases/notes referred to him as Chairman of the Committee on Complaints and Investigation, to wit:

(1) The case of Edgardo Danugrao, et al vs. Danilo Fernandez for grave abuse of authority and misconduct. A committee hearing was conducted for the said case where the following showed up:

Acting Barangay Capt. Edgardo Danugrao, respondent Danilo Fernandez, the Treasurer Mary Jane Casillano and the members of the Lupon Tagapamayapa, who filed a complaint alleging that they have not received their honorarium for the months of April-June 2003, namely: Loida Napalan, Conchita Ela and Merope Tala. In the preliminary hearing, the parties failed to arrive into an amicable settlement. Committee Reports

Councilor Cajudo mentioned to the body that the communication she received dated April 1, 2004 regarding the anonymous complaint against Brgy. Kgd. Angie Socorro Barroga of Brgy. Gordon Heights has already been discussed and answered thus there is no point of discussing the matter further.

On another item, Councilor Cajudo reported her visit at New Cabalan Elementary School where she attended a meeting of the GSP Council. She said that there were great improvements in the school when the principal showed her around, except for one thing that caught her attention which the principal skipped to mention; the Schools electrical lines are installed on live trees within the school compound. Councilor Cajudo called the attention of the Engineering Office and the School Administration. The principal added that the PUD has already conducted an inspection regarding the kind of installation done but to date, no action was taken. She also added that their school will represent the City to the Regional Math and Science competition.

The Presiding Officer, briefly interrupted the reporting of Councilor Cajudo and called the attention of Councilors Marzan and Gordon on matters of public safety. He also referred to Councilor Aquino the report of Councilor Cajudo regarding the electrical line installation and consequently the PUD action.

For continuation, Councilor Cajudo informed the body of the meeting she attended together with Councilor Gordon, Brgy. Capt. Ubungen and TMB personnel at Iram Elementary School. They met with the Iram residents and tricycle drivers to hear their side on the City Mayor’s Executive Order regarding the rotation of services between jeepneys and tricycles in the area. They recommended to allow both jeepney and tricycle services to ply the route simultaneously. Councilor Cajudo told the residents that the City Mayor will be informed of their recommendations.

Lastly, Councilor Cajudo, in reply to the referral of the Presiding Officer for her to check the problem of the Sta. Rita – Filtration Gate, operators and drivers regarding the non-submission of financial status and standing of the members by Mr. Jun Rosal, their President. She said that she already sent Mr. Rosal a letter giving him 5 days upon receipt thereof to settle his commitments.

On the issue of the growing numbers of the food peddlers, Councilor Andrada reported the action she has to undertake together with the sanitary inspectors of the City Health Department (CHO) regarding the compliance of the peddlers to the sanitation code. A saturation drive along Magsaysay Drive, Rizal Ave., EBB and WBB especially within the vicinity of schools was conducted. Food peddlers were advised to secure or renew their Health Certificates in compliance with PD 856, otherwise known as the “Sanitation Code of the Philippines.” Violation on the said code will be charged to those who will fail to comply. To date, the City Health Officer has already submitted to the City Mayor her recommendations for those who will be issued permit and the other is the order to seize the operation of those who have not complied.

In another committee report, Councilor Andrada tackled the water sample testing of the deep well/spring water at Johnson Extension, EBB as per request by Brgy. Kgd. Lyn Reyes, Brgy. Kgd. on Health. The water testing conducted on Aug. 12, 2004 by the CHD yielded a positive result. The barangay officials and residents were furnished a copy of the result and were given a warning of its being unsafe for drinking. Councilor Andrada gathered reports that their warning remains unheeded. She said, that two years ago Subicwater constructed a main pipeline to service the residents of Johnson Ext. and Little Baguio, done thru the efforts of the then Mayor Kate H. Gordon. But when the pipeline was completed, very few applied for connections because some would like the connection to be free of charge which the Subicwater may not grant.

The Chair on Committee on Cooperatives, Councilor Bella Asuncion gave a brief discussion on what she learned after attending the organizational meeting of Cooperative Union of Olongapo and Zambales last Aug. 29, 2004 at Sta. Rita. She said that the objective of the meeting is for the cooperatives of Olongapo and Zambales to be an apex organization of all types of primary cooperatives and federations. It is envisioned to act as an intermediary to its members and deliver services such as information dissemination; business and livelihood support; promote knowledge of the cooperative principles; professionals and technical services; education and training; and policy development for cooperative. Twenty (20) cooperative members were in attendance. Kgd. Cesar Santiago of KABALIKAT was elected Chairman; Mr. Fermin Elago of Olongapo City Workers General Services Multi Purpose Cooperative was elected as Vice-Chairman. The facilitators of the said meeting were Mr. Edmundo Engao, Cooperative Development. Authority Specialist, and Mr. Anacleto Delos Santos, City Consultant.

Next to give a committee report was Councilor Atienza. He reminded the City Councilors who has not yet submitted the committee composition of their respective committee chairmanship to act on it. In another topic, he apprised the body on the result of the research he conducted for the ratification of the waiver of possessory rights executed by Juliana Sevilla. The said parcel of land is located at Cristobal St., Brgy. Sta. Rita where the Basketball Court is located. The registered owner appearing in its tax declaration is in the name of the Republic of the Philippines but Juliana Sevilla is in claim of its ownership. With the waiver she executed, it clears the title of the city over that property thus is now ready for ratification by the august body. Lastly, he also said that part of the agenda of the session is a resolution he made addressing the letter of appeal by Brgy. Capt. Danilo Fernandez to the body.

Councilor Ted del Rosario, the Chair or Committee on Trade, Business, Tourism and Economic Enterprise read the memorandum dated Aug. 16, 2004 from the Department of Tourism which enjoins all nations throughout the world to celebrate the 25th World Tourism Day on the 27th of Sept. 2004. He also mentioned that 10 activities were suggested for its celebration and one of which is an official declaration from the Local Sanggunian of the World Tourism Day, which he will endorse as an urgent matter in their agenda. Furthermore, Councilor del Rosario also informed the body of the result of the planning session for Micro Small and Medium Enterprises Development conducted just this morning initiated by the Mayor’s Office thru the Administrator’s Office. It was discussed that to attract more city investors, there is a need to have the Local Incentives Code No. 2, fiscal and non-fiscal. There is also a need to review and amend some parts of the Revenue Code which hinders influx of investments. Our One-Stop-Shop of business enterprises still needs further streamlining. It was also suggested in the said planning session to have an Overseas Filipino Investment Desk which will give assistance and guidance to the overseas workers on how and where to invest their earnings. Lastly, it was also mentioned to conduct an inventory of vacant lots for the would-be investors.

The Presiding Officer added that Councilors Atienza and del Rosario were already asked to review the Local Revenue Code.

Councilor Piano, shared that thru the invitation of the City Mayor, a dialogue was forged with the groups opposing the impending water rate increase and the Privatization of P.U.D. This was held at the FMA Hall. At this meeting, the oppositor’s spokesperson, Mr. Benjamin Miranda, explained why they are totally against the water rate increase, along with Mr. Sammy Matias and the others. It is also for this reason why they are called upon by the City Mayor because they wanted to conduct a rally last Saturday, August 28. Furthermore, the said oppositors mentioned the problems regarding the electrical services of the City. For example, one of the reports submitted to the former Mayor Kate Gordon, is about the tree that was turned to an electrical post which is of high risk to the area. They even mentioned other concerns such as garbage and garbage collection in the City.

Last Saturday on local TV, our Mayor told that Subic Water put on hold the water rate increase. This is one of the reasons why the rally was not held, he said.

The Councilor’s second report is about the arrival of the Deputy Director of National Telecommunications Commission in Olongapo last August 26. They tackled important issues on the NTC Memorandum regarding the sales and repair of cellphones. He is also inviting all who have concerns with this matter, and stated that on Friday the forum will be held to further address the issues. NTC personnel themselves will explain the Memorandum Circular. Councilor Piano mentioned that 125 businessmen will attend the said forum. The Councilor also advised that if the FMA Hall is not big enough for all who will attend, the visitors can still view or hear it through their T.V. or radios at home.

Councilor Piano reported on the results of the citywide activity of the YMCA specifically on the “Araw ng Maynila Swimming Competition”. The results are as follows:

1. Gerard Robin Ebue - 3 silver, 2 bronze

2. Lorelie Etrone - 1 gold patch

3. Mervin Mandadero - 1 bronze

4. Hillary Lee - 1 gold, 1 bronze

He particularly mentioned that in exchange for their “job well done” the City promised monetary gifts for the Batang Pinoy winners who were the same children stated above had not yet received at this point. Also, last August 27 and 28 the 3rd YMCA G4 Chess Tournament was held at the Olongapo City Mall. The overall champion for the elementary division came from the Columban College Main Campus, the Olongapo City National High School for the secondary level and for the college level the overall champion came from Mondriaan Aura College. All the participants would like to thank the Olongapo City Mall for the venue and also the Tournament Director Hubert Magrata along with the Chairman of inter-school tournament Mr. Edgar Dimen.

For his next report, Councilor Piano said that a committee hearing was recently held for the application of Digitel to construct a cellsite in Gordon Heights. Some of the important things were tackled, such as the passage of a Barangay Council Resolution before the council can pass the aforesaid resolution request. The Barangay Chairman also revised the policy of the 50-meter radius for the cellsite construction from the 200m in its immediate vicinity. Other than that, they would also need to secure clearances from the NTC, Air Transportation and the Subic Bay International Airport. Documents of the property where the installation will be constructed are also needed. One important issue that the City Council mentioned is an Affidavit of Undertaking. Under the City Council Resolution No. 16, Series of 1995 this land is under a reserve area, therefore a Deed of Undertaking is required to bring the authority of the land back to the City.

Councilor Piano also shared that he attended a hearing regarding Innove Communications at the Subic Bay Metropolitan Authority. The company proposed telecommunication services at the Subic Bay Freeport and will also include the City of Olongapo. In the hearing which was presided by Atty. Vonn Rodriguez, the Subic Telecom, opposing party motioned that the hearing must be deferred. Subic Telecom also mentioned that their request to renew their contract as the exclusive Telecom provider of the City must be prioritized. But according to Councilor Piano under Executive Order 7125, the Telecom industry is open for anyone and everyone.

Councilor Aquino gave the highlights of the proposed Boardwalk Project. The project is currently under construction with a total budget amount of Php 28 million, where Php 20 million will come from the Department of Tourism and Php 8 million from our local funds. The said Boardwalk will be situated in Volunteers Park. The other Boardwalk project is at the Driftwood Beach, which already commenced under a total budget of Php 6.9 million. This was also approved by virtue of Ordinance No. 46, Series of 2004. The budget from the Department of Tourism is set at Php 3.5 million, while the local government of Olongapo shared Php 3.4 million.

Councilor Marzan reported that together with the chairman of the Committee on Education, they received a letter from Mr. Lamberto Samson, PTCA President of CENTEX, who stated that the school needs to have its own building. A hearing was conducted regarding this matter which was heard by Councilors Marzan, Cajudo and Buenafe along with CENTEX’s principal Ms. Nilda Quitaneg, The letter sent by the PTCA President aired that the parents are only concerned on the well being of their children, she said.

So, the first step that Councilor Marzan and the others took, was to refer the matter to the City Engineering for a technical feasibility study. The other option discussed was to create more homerooms if there is not enough budget for the building. Their second step was to indorse Mr. Lamberto’s letter to the Department of Education for assistance. They will also forward it to the School Board to check if there is budget for such construction.

Councilor Piano also added that if it is possible to calibrate all fuel tanks of all the gas stations in Olongapo City, to be sure that the consumers get what they have paid for. This is to avoid the malpractice that happened to the consumers in Metro Manila.

With this, the Chairman instructed Councilor Brian to check if all fuel tanks of gasoline stations in the City are properly calibrated.
