AN ORDINANCE REVERTING THE AMOUNT OF ONE HUNDRED FIFTY TWO THOUSAND PESOS (PHP152,000.00) FROM SALARIES AND WAGES -CASUAL/CONTRACTUAL UNDER PERSONAL SERVICES TO OFFICE EQUIPMENT UNDER CAPITAL OUTLAY (CO) BOTH UNDER
THE JAMES L. GORDON MEMORIAL HOSPITAL

BE IT ORDAINED, BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED, THAT:

SECTION 1. The amount of One Hundred Fifty Two Thousand Pesos (PhP152,000.00) is hereby reverted from Salaries and Wages – Casual/Contractual under Personal Services to Office Equipment under Capital Outlay (CO) both under the James L. Gordon Memorial Hospital

SECTION 2. This Ordinance shall be subject to the usual accounting and auditing rules and regulations.


SECTION 3. The pertinent letter request of the Honorable City Mayor James Gordon, Jr. dated June 22, 2005 and the memorandum of Mr. Ferdie M. Magrata, Hospital Administrator, James L. Gordon Memorial Hospital, dated 02 June 2005 are hereby made as integral parts of this Ordinance.

SECTION 4. This Ordinance shall take effect upon its approval.

BE IT ORDAINED, BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED, THAT:

SECTION 1. The amount of Ten Thousand Pesos (PhP10,000.00) is hereby appropriated from the Unappropriated Balance of the General Fund not otherwise appropriated and the same is hereby made available as financial assistance to Ms. Marilou Gamboa.

SECTION 2. This ordinance shall be subject to the usual accounting and auditing rules and regulations.

SECTION 3. The pertinent letter request of Ms. Marilyn H. Custodio, Social Welfare Assistant of City Social Welfare and Development Office dated May 24, 2005 is hereby made as integral part of this Ordinance.



SECTION 4. This Ordinance shall take effect upon the availability of funds from the Office of the City Mayor.

Re: 1) Proposed fees for usage of Rizal Triangle Multi-
Purpose Center, Marikit Park, East Tapinac Oval Track
and Volunteers’ Park

2) Imposition of fees for streamers, motorcades and
application for telecom-tower site-acquisition.

The hearing was called to order on or about 10:30am, 28 June 2005 by Kgd. Ed Piano.

1. Ric Cando discussed the rationale behind the proposal to impose fees on usage of Rizal Triangle Multi-Purpose Center, Marikit Park, Tapinac Oval Track and Volunteers’ Park. He explained that this is primarily to cover cost of maintenance, defray electric and water consumption and to fund salaries/wages of security personnel to be assigned on said parks.

2. City Treasurer Marcelino Andawi explained in detail the Finance Committee’s proposal.

3. The Vice Mayor raised his concern about the proposal to charge fees to individuals engaging in numerous sports activities, spectators enjoying the games, or folks who frequent our parks for various reasons. He surmised that the reason the city government built these parks and spent considerable amount of money is for our constituents to have a decent, safe and enjoyable place to stroll, and they expect these to be free.

4. Mr. Johnny Choa replied that indeed the committee realize that Olongapo City is a “Child Friendly City” national awardee, which was the reason why the proposal only covers organized activities, people going in and out of the park on their own is not covered by the proposal.

5. In that regard, the body agreed to charge fees only on activities that are profit-oriented or commercial in nature especially if they requested for exclusive use of the park. Non-profit organizations/activities will need to pay only a minimal amount to cover cost of utilities such as electricity and water.

6. Brgy officials for their part requested that a certain percentage of the fees paid by organized users should be given to barangay where parks fall under their area of jurisdiction. It was agreed that the matter would be taken up with the city mayor who have the authority to enter into agreements to satisfy their request.

7. The proposal to allow stalls such as snack bars, souvenir shops and other booths in Volunteers’ Park encountered opposition for reasons such as this will create traffic problem, it will unduly compete with occupants of the city mall, perceived sanitation problem, and building “pansamantagal” structures usually result to untidy parks . . . The means to award such stalls if ever this will push thru were also placed under suspicion since the proposed rental rates were unusually low raising speculation that only “favored ones” will benefit from the proposal especially when Parks Manager Ric Cando revealed that he already received applications for a privilege to do business in the park. Proposal for booth rental on other parks under discussion received the same sentiment.

8. Rates/Fees for Streamers:

P80/sq. meter provided that minimum fee shall be P400.00

and that Removal Fee/Bond of P200 shall be paid in advance.

9. Rates/Fees for Motorcade (including mobile escort)

City proper excluding New Cabalan and Bo. Barretto:

P250 per hour with minimum of P 500.00

City proper including New Cabalan and Bo. Barretto:

P250 per hour with minimum of P 1,000.00

10. Fees on Cell Site / Communication Towers: P 10,000.00 application fee (one-time) for site acquisition shall be charged. This in addition to the P 5,000.00 annual fee as prescribed in the City Revenue Code.

A RESOLUTION APPROVING THE ANNUAL BUDGET OF BARANGAY STA RITA, CITY OF OLONGAPO FOR CALENDAR YEAR 2005

On motion of Councilor Edwin J. Piano, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to approve, as it hereby approves the Barangay Budget of Barangay Sta. Rita, City of Olongapo for the Calendar Year 2005 considering that the budget as contained in Barangay Resolution No. 06, Series of 2005 of Barangay Sta. Rita, upon review by the Sangguniang Panlungsod, has substantially complied with the requirements and limitation set forth under R.A. No. 7160 or the Local Government Code of 1991 and other pertinent issuances, circulars and memoranda with respect to Barangay Budgets: PROVIDED, that the City Accountant is enjoined to observe that the conditions enumerated by the City Budget Officer in his endorsement letter of May 16, 2005 on the matter which form an integral part of this Resolution are strictly complied with, and the requirements imposed by City Resolution No. 3, Series of 1996 are fully satisfied.

Suspek bawal iharap sa media

Ang Pilipino STAR Ngayon

Bilang pagkilala sa sinasabi ng Konstitusyon na "presumption of innocence" ng mga akusado hangga’t hindi napapatunayang nagkasala, inaprubahan ng House committee on human rights ang panukalang batas na nagbabawal i-display ang mga ito sa publiko lalo na sa pamamagitan ng media.

Nakapaloob ang panukala sa House Bills 833,3582, 3160 at 3581 na naglalayong proteksiyunan ang karapatan ng mga akusado lalo pa’t sumasailalim pa lamang sa imbestigasyon ang kanilang kaso.

Ayon kay Akbayan Rep. Loretta Ann Rosales, chair ng komite, masyadong nakakababa ng dignidad ang ginagawang pagdi-display ng mga akusado gayong hindi pa naman siguradong mayroon nga silang kasalanan.

"Kalimitan, akusado pa lang pero parang siguradong-sigurado na ang pulisya na sila nga ay nagkasala," ani Rosales.

Sinabi pa ni Rosales na nawawala na ang integridad ng isang tao na itinuturing pa lang na suspek sa sandaling iprisinta sa media kahit hindi pa sila nahahatulan ng korte.

"The eagerness of law enforcers plus the media hype damage the integrity of the persons accused even before they are proven guilty of their offenses," pahayag ni Rosales.

Dapat din aniyang maging responsable ang media lalo na sa telebisyon dahil kalimitang nalalabag ang karapatan ng mga akusado.

Hindi aniya maiiwasang makisimpatiya ang mga viewers sa mga biktima kahit wala pa sa korte ang kaso.

RESOLUTION NO. 71
(Series of 2005)

A RESOLUTION OPPOSING THE APPLICATION OF GV BROADCASTING SYSTEM, INC. FOR THE ISSUANCE OF A CERTIFICATE OF PUBLIC CONVENIENCE TO INSTALL, OPERATE AND MAINTAIN AN FM RADIO STATION IN OLONGAPO CITY

WHEREAS, there are three (3) FM Radio Stations (DWOK, DWSL, DWSB) operating in Olongapo City and there are also three (3) registered AM Radio Stations (DWGO, DWHL, with DZOR-inactive). Moreover, AM and FM signals from other parts of Luzon specially Metro Manila are spilling over to Olongapo City;

WHEREAS, with the application of GV Broadcasting to operate and maintain an FM station in the city, filed at the National Telecommunications Commission, it will become an additional radio station that will compete with the existing radio facilities servicing the city, who are now suffering the economic pinch due to high cost of operation, maintenance and the meager advertising market to depend on;

WHEREAS, the Committee on Telecommunications and Information Communication Technology conducted a committee hearing in order to get facts and came up with the official position on the matter;

WHEREAS, further, on the public hearing conducted at the Sangguniang Panlungsod for the said purpose, GV Broadcasting failed to present the pertinent feasibility study and technical specification that will allay the apprehension of financial peril on the part of the local radio stations in the city with the additional entry of another radio station;

WHEREAS, in the presentation of GV Broadcasting in the same hearing, they also failed to specify the exact site for the construction of their radio station and transmission tower in order for the City Council to determine if there will be violation to any existing City Ordinance;

WHEREAS, while the city appreciates the good intention of GV Broadcasting to set up a radio broadcasting station in the city, the City Government of Olongapo is constrained to oppose the application at this time due to its financial viability which would negatively affect even the existing radio stations and lack of necessary data for the council to arrive at intelligent decision. However, this does not prevent them from submitting another application in the future when the state of over-all business situation becomes conducive to accepting additional radio stations in the city and all required documents are ready for presentation;

NOW, THEREFORE, on motion of Councilor Edwin J. Piano, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to oppose, as it hereby opposes the Application of GV Broadcasting System, Inc. for the Issuance of a Certificate of Public Convenience to Install, Operate and Maintain FM Radio Station in Olongapo City.

Let copies of this Resolution be furnished the National Telecommunications Commissions and the GV Broadcasting System, Inc. for their information and record.

A RESOLUTION CHANGING THE SIGNATORIES RESPONSIBLE FOR FINANCIAL TRANSACTIONS IN THE LETTER OF UNDERSTANDING (LOU) BETWEEN THE UNITED NATIONS FAMILY PLANNING ACTIVITY (UNFPA) AND THE CITY GOVERNMENT OF OLONGAPO AS WELL AS THE BANK SIGNATORIES OF THE REPRODUCTIVE HEALTH
AND PDS PROJECTS

WHEREAS, pursuant to Resolution No. 43, Series of 2005, the opening of two (2) Trust Fund Checking Accounts with the Development Bank of the Philippines Subic Bay Branch for the United Nations Fund for Family Planning Activity (UNFPA) financial assistance to the City of Olongapo on the implementation of the UNFPA 6th country program had been approved;

WHEREAS, a Letter of Understanding (LOU) entered between the City Mayor , Honorable James Gordon , Jr. and the UNFPA for the adoption and implementation of their Country Program Action Plan (CPAP) had also been ratified by virtue of Resolution No. 54, series of 2005;

WHEREAS, however, the UNFPA noted a discrepancy between the authorized signatories listed in both resolutions;

WHEREAS, consequently, the UNFPA reiterates that signatories listed in the LOU are one and the same signatories for the bank account, to wit:

RESOLVED, AS IT IS HEREBY RESOLVED, by the Members of the Sangguniang Panlungsod in session assembled, to change, as it hereby changes the signatories responsible for financial transactions in the Letter Of Understanding between the United Nations Family Planning Activity and the City Government Of Olongapo as well as the bank signatories of the Reproductive Health and PDS Projects

HON. JAMES J. GORDON, JR. TO ENTER INTO AND SIGN A MEMORANDUM OF AGREEMENT WITH THE AIDS SOCIETY OF THE PHILIPPINES, INC. REGARDING THE IMPLEMENTATION OF THE 6TH COUNTRY PROGRAMME ACTION PLAN (CPAP) OF THE UNITED NATIONS FUND FOR FAMILY PLANNING ACTIVITY (UNFPA)


WHEREAS, the rising incidence of Human Immuno-Deficiency Virus (HIV/Acquired Immune-Deficiency Syndrome (AIDS) in the Asian region poses a significant threat to our population;

WHEREAS, prevention and control of the spread of HIV/AIDS is part of the comprehensive action plan of the UNFPA reproductive health programme;

WHEREAS, the AIDS Society of the Philippines, Inc. (ASP) is mandated to coordinate with the local government of Olongapo to provide technical & logistical assistance for the 3-year UNFPA project entitled, “Reducing the Vulnerabilities and Susceptibilities of HIV/AIDS Transmission among Men-Who-Have-Sex-With-Men (MSM) and Injecting Drug Users (IDUs) in the City of Olongapo: An Intervention Work”, which was granted on April 4, 2005;

WHEREAS, the City Government of Olongapo seriously supports measures to improve the health and general well-being of the people;

FOR CALENDAR YEAR 2005


On joint motion of Councilors Edwin J. Piano & Cynthia G. Cajudo, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to approve, as it hereby approves the Barangay Budget of Barangay New Ilalim, City of Olongapo for the Calendar Year 2005 considering that the budget as contained in Barangay Resolution No. 001, Series of 2005 of Barangay New Ilalim, upon review by the Sangguniang Panlungsod, has substantially complied with the requirements and limitation set forth under R.A. No. 7160 or the Local Government Code of 1991 and other pertinent issuances, circulars and memoranda with respect to Barangay Budgets: PROVIDED, that the City Accountant is enjoined to observe that the conditions enumerated by the City Budget Officer in his endorsement letter of April 28, 2005 on the matter which form an integral part of this Resolution are strictly complied with, and the requirements imposed by City Resolution No. 3, Series of 1996 are fully satisfied.

A RESOLUTION EXPRESSING SYMPATHY TO THE BEREAVED
FAMILY OF MR. LEONCIO BUGARIN DALLUAY, SR.

WHEREAS, Mr. Leoncio Bugarin Dalluay, Sr., one of the City’s prominent undertakers and socio-civic leaders, died on May 8, 2005 at the age of 75;

WHEREAS, Mr. Dalluay will always be remembered as venturer, the unconventional businessman and as a father who cultivated within his children patience, hardwork and dedication, he himself exemplified. As such, his children continued and loved the business he established with utmost ingenuity;

WHEREAS, on top of his busy schedule, Mr. Dalluay found time to direct his energies in socio-civic activities and was a firm supporter of various City programs and projects. His business stood as witness to countless acts of charity he willingly shared;

WHEREAS, the City Government of Olongapo joins the Dalluay Family in this moment of grief and prays that God’s enduring presence will help them cope with the loss of their patriarch;

A RESOLUTION EXTENDING SYMPATHIES AND
CONDOLENCES TO THE BEREAVED FAMILY AND GIVING
RECOGNITION FOR THE CONTRIBUTIONS OF THE LATE
DR. ERNESTO LIRAZAN BATAPA

WHEREAS, Dr. Ernesto L. Batapa died in God’s grace on May 10, 2005, at the age of sixty-nine (69), after a lingering illness;

WHEREAS, Dr. Batapa will always be remembered as the dynamic president of the Senior Citizens’Association and an accomplished leader of the Peace Makers Senior Citizen’s organization of Barangay Banicain from 1997 up to the time of his death;

WHEREAS, his feat in the said organizations catapulted him to become the President of the Federation of Senior Citizen’s Associations of the Philippines (FSCAP), Olongapo City, Chapter where he served his two (2) terms from 1999 and was elected twice as its Regional Treasurer;

WHEREAS, during his incumbency, he put up a program for all members called “Abuluyan Mutual Aid Plan”, and implemented the Office of the Senior Citizens’ Affairs (OSCA) Chairmanship in every barangay. As president, he entered into a Memorandum of Agreement with one of the funeral service providers in the city to enable its members to avail themselves of cheaper funeral services;

WHEREAS, Dr. Ernesto L. Batapa was conferred as Region III National Awardee for the “Ulirang Nakatatanda” 2004, having been nominated to represent Region III;

WHEREAS, Dr. Batapa was an active member and Chairman of the Lupon Tagapamayapa of Barangay Banicain and member of the PNP Council for the Elders covering four (4) barangays and co-opted officer of the Boy Scouts of the Philippines, James L. Gordon Council;

WHEREAS, Dr. Batapa earned the trust and confidence of the City Mayor and established a good working relationship with the Olongapo City Social Welfare and Development Office (OCSWD) as a partner in the implementation of the office’s programs and services for the elderly;

WHEREAS, Dr. Batapa was known for his integrity, honesty and objectivity, a loving husband and a good provider for his family;

NOW, THEREFORE, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to extend, as it hereby extends Sympathies And Condolences To The Bereaved Family And Giving Recognition For The Contributions Of The Late Dr. Ernesto Lirazan Batapa.

WHEREAS, the City Police Force fashioned out the said victory through their high level of commitment and impressive teamwork with Olongapo City residents which made the City prouder of their exemplary dedication significant to the City’s bemedaled peace and order situation;

WHEREAS, as a vision-driven and pro-active department, OCPO’s prompt and invaluable assistance as well as advance tactical knowledge in various police operations were significant in mitigating crime of all sorts and further ensured the safety of civilians and protection of properties;

A RESOLUTION DECLARING AND RESERVING
ALL OPEN AND ACCRETION AREAS ALONG HALFMOON BEACH
AS ECO-TOURISM SITES OF THE CITY

WHEREAS, the turn over agreement entered into by and between the governments of the United States of America and the Philippines, explicitly provided that waters along Halfmoon Beach be open to the public for swimming and other recreational purposes;

WHEREAS, the City Government is working on and has made representations with the Department of Environment and Natural Resources (DENR) on the implementation of the said turn over agreement;

WHEREAS, over the years, accretion due to the natural course of nature happened to our beach areas including Halfmoon Beach which should be developed to its full potential to boost the growing tourism industry of the city;

WHEREAS, the DENR recommended the area as ideal site for eco-tourism;

NOW, THEREFORE, on motion of Councilor Teodoro D. Del Rosario, with the majority decision of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to declare and reserve, as it hereby declares and reserves all open and accretion areas along Halfmoon Beach as Eco-Tourism Sites of the City.

WHEREAS, the Letter of Understanding between the City of Olongapo and UNFPA signed on April 14, 2005 states all the agreed responsibilities of the parties concerned for the implementation of their Country Programme Action Plan (CPAP);

WHEREAS, in the interest of public service, the Letter of Understanding needs to be formally ratified to complete the legal requirements in its implementation;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to approve, as it hereby approves the Barangay Budget of Barangay Banicain, City of Olongapo for the Calendar Year 2005 considering that the budget as contained in Barangay Resolution No. 01, Series of 2005 of Barangay Banicain, upon review by the Sangguniang Panlungsod, has substantially complied with the requirements and limitation set forth under R.A. No. 7160 or the Local Government Code of 1991 and other pertinent issuances, circulars and memoranda with respect to Barangay Budgets: PROVIDED, that the City Accountant is enjoined to observe that the conditions enumerated by the City Budget Officer in his endorsement letter of April 07, 2005 on the matter which form an integral part of this Resolution are strictly complied with, and the requirements imposed by City Resolution No. 3, Series of 1996 are fully satisfied.

ATTY. ANGELITO OROZCO, AS CITY GOVERNMENT DEPARTMENT HEAD II (CITY LEGAL OFFICER), SG-26, UNDER THE LEGAL OFFICE


WHEREAS, the City Mayor has appointed Atty. Angelito Orozco as City Department Head II, City Legal Officer pursuant to Civil Service Laws, Rules and Regulations;

WHEREAS, Section 454(d) of Republic Act 7160, otherwise known as the Local Government Code of 1991, provides that heads of departments shall be appointed by the City Mayor with the concurrence of the majority of all Members of the Sangguniang Panlungsod;

NOW, THEREFORE, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to confirm, as it hereby confirms the appointment of Atty. BE IT ORDAINED, BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED, THAT:

SECTION 1. The amount of One Million Two Hundred Nineteen Thousand Three Hundred Seventy Five Pesos & 50/100 (PhP1,219,375.50) is hereby appropriated for the 3rd installment payment for the purchase of lot at Barangay Old Cabalan, Olongapo City from National Development Company, in accordance with the Deed of Conditional Sale entered into by National Development Company and the City Government of Olongapo chargeable against the Trust Fund (Sales of Government Lots).
