Bill creates Local Housing Boards

THE House of Representatives has approved a bill mandating the creation of the Local Housing Board (LHB) in every city and big municipality to complement the efforts of shelter agencies in carrying out the Urban Development and Housing Act.

Under the Act, cities and first- to third-class municipalities shall create their own LHBs that will formulate, implement and monitor policies on the provision of housing to the masses.

The LHBs will also ensure the observance of just and humane procedures in cases of eviction and demolition.

The bill, passed on third and final reading Tuesday night, gave fourth and fifth class municipalities the option to create their own LHBs.

“The bill will give local government units more autonomy, consistent with the Constitution and the Local Government Code, in providing housing to their respective localities,” Rep. Eduardo Zialcita, chair of the Committee on Housing and Urban Development, said.

The bill also espouses openness, accountability and multi­sectoral participation in the planning and implementation of housing programs.

The House also approved on third reading a bill giving relief to persons who availed themselves of housing loans but are unable to pay their obligations to government financial institutions owing to the financial crisis.

The House also passed a bill allowing the sale of government-owned properties to the occupants without going through a bidding.

A RESOLUTION OF CONDOLENCE TO THE BEREAVED FAMILY OF
MR. ANACLETO P. DELOS SANTOS AND RECOGNIZING HIS INVALUABLE CONTRIBUTIONS TO THE CITY OF OLONGAPO


WHEREAS, Mr. Anacleto delos Santos, or Cleto as fondly called by many, passed away on May 10, 2005;

WHEREAS, he assumed the responsibility for love of work and comrades of the trade, the cooperative and transport business;

WHEREAS, the people of Olongapo, close associates and especially his family were shocked upon knowing the death of a well-loved volunteer of Olongapo and Subic Bay Metropolitan Authority (SBMA);

WHEREAS, his contribution to the City by working with then Mayor, now Senator Richard J. Gordon in implementing the Color Coded Transport System of Olongapo has been recognized and widely acclaimed by those whom he has reached in the national and international fora;

WHEREAS, Cleto was instrumental in the formation of the first transport cooperative in the City, which became a model for many cooperatives in the country and was founder of the Traffic Management Board as well;

WHEREAS, he helped design a module for the training of professional drivers and for trouble shooting for simple mechanical defects of automotive engines under the Subic Bay Opportunities Industrialization Foundation, Inc. (SBOIFI) which graduated hundreds of young men and women;

WHEREAS, his expertise in the field of cooperatives has been recognized nationally by making him the general manager of the Kapisanan ng Pamasaherong Sasakyan ng Pilipinas, Inc. (KPPI) which led the recently concluded convention at Days Hotel, Subic Bay Freeport;

WHEREAS, Mr. delos Santos at the time of his death was the consultant of the Cooperative Development Authority, Manila, Branch Manager of the Great Domestic Insurance, Olongapo City and City Mayor’s Consultant on cooperatives. He was also the General Manager of Olongapo, Subic, Castillejos, San Marcelino Transport Service Multi-Purpose Cooperative, Inc. (OSCSMTSMPCI) from 1974-1998 and became its consultant in 2000-2002;

WHEREAS, in behalf of the thousands of drivers and operators whom he had helped and inspired to form a cooperative, the City of Olongapo thru the Sangguniang Panlungsod offers this Resolution of condolence to his bereaved family and offers prayers for his eternal rest;

NOW, THEREFORE, with the unanimous accord of the members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to condole, as it hereby condoles with the bereaved family of Mr. Anacleto P. Delos Santos and to recognize, as it hereby recognizes his invaluable contributions to the City of Olongapo.

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, that copies of this Resolution be presented to the bereaved family before his final rest and to the KPPI for their information.

A RESOLUTION COMMISERATING WITH THE BEREAVED FAMILIES OF DR. JESSIE A. DALIGDIG AND DR. NORMAN M. TUNGOL OVER THEIR UNTIMELY DEATHS


WHEREAS, Philippine Air Force Huey UH – 1H with tail number Stringer 324 crashed into Mount Namat, Barangay Ligaya, Nueva Ecija last April 28, 2005, instantly killing all its boarders, Philippine National Red Cross Governor Punongbayan, four scientists and staff of the Philippine Institute of Volcanology and Seismology (PHIVOLCS), two Philippine Air Force pilots and two soldiers;

WHEREAS, amongst the PHIVOLCS contingents were Dr. Jessie A. Daligdig and Dr. Norman M. Tungol, who were on an official mission spearheaded by Senator Richard J. Gordon, to conduct an aerial assessment of various natural hazards and evaluate the safest rehabilitation site and resettlement area for the calamity-stricken residents of Aurora;

WHEREAS, Dr. Jessie A. Daligdig was the study leader of the ground rupture of the M7.8 July 16, 1990 Luzon earthquake. His research was instrumental to the conduct of various rescue and retrieval operations where the Olongapo City Rescue Team actively participated. This eventually led the institute project on Active Fault Studies in the Philippines, including the mapping of the Marikina Valley Fault System (MVFS) in 1991;

WHEREAS, Dr. Daligdig was also among the group of PHIVOLCS personnel led by Dr. Raymundo S. Punongbayan who monitored the 1991 eruption of Mount Pinatubo and accomplished a comprehensive research on natural hazard mitigation which translated workplans to the preservation of lives and properties;

WHEREAS, on the other hand, Dr. Norman M. Tungol joined the PHIVOLCS as a Science Research Specialist II in 1991 and relentlessly pursued the monitoring, mapping and assessment of Pinatubo Volcano lahars. Through his experience and expertise in engineering geology, geological hazards, volcanology, hydrology and other fields, PHIVOLCS research on post-eruption lahars spared countless communities in Central Luzon, including Olongapo City, from greater devastation;

WHEREAS, Olongapo City acknowledges the legacy of these two great scientists for making volcanic and earthquake hazards understandable to the public. They lent their expertise with so much passion that their own lives counted to the cause of saving more lives during potentially disastrous geologic events in Philippine history;

WHEREAS, the people and the City Government of Olongapo share the grief and sorrow of their respective family members and pray that they will graciously move on from this tragic loss;

NOW, THEREFORE, with the unanimous accord of the members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to commiserate, as it hereby commiserates with the bereaved families of Dr. Jessie A. Daligdig and Dr. Norman M. Tungol over their untimely deaths.

A RESOLUTION EXPRESSING PROFOUND SORROW OVER THE UNTIMELY DEMISE OF PHILIPPINE NATIONAL RED CROSS (PNRC) GOVERNOR AND FORMER PHILIPPINE INSTITUTE OF VOLCANOLOGY AND SEISMOLOGY (PHIVOLCS) DIRECTOR, DR. RAYMUNDO S. PUNONGBAYAN AND CONDOLING WITH HIS BEREAVED FAMILY

WHEREAS, Dr. Raymundo S. Punongbayan, Former Director of the Philippine Institute of Volcanology and Seismology (PHIVOLCS) and Governor of the Philippine National Red Cross (PNRC) died on April 28, 2005 while on an official mission;

WHEREAS, the entire nation joins the Philippine scientific community lament over the loss of the man who successfully predicted the Mount Pinatubo eruption, one of the world’s biggest volcanic eruptions in the last century and the geologist who was instrumental in making the concepts of volcanoes and earthquakes understandable by the “common tao”;

WHEREAS, through his efforts, Phivolcs served as the constant sentinel of natural hazard mitigation and as such produced educational materials on volcano monitoring, earthquakes and other disasters where Phivolcs earned such a distinguished stature here and abroad through his exceptional contributions and servant-leadership;

WHEREAS, Olongapo could not have survived the wrath and ravages of Mount Pinatubo eruption and all its after effects, without the ingenuity of the man who through intense research mitigated the greater damages of the said eruption. For this, Olongapo City will forever be indebted to the man who literally burned brows and provided scientific relief for this cause which translated to the preservation of lives and properties;

WHEREAS, without a haze of tiredness, Dr. Punongbayan carried out the exciting quest of his field even after his retirement as Phivolcs director in December 2002. He could have opted to be a consultant for related fields in the United States or in Japan after the said retirement but “RSP,” as he was fondly called by his colleagues, pursued a greater homebase assignment for the PNRC. Indeed, service to his motherland was his comfort zone;

WHEREAS, even at the hour of his death, the PNRC Governor together with eight others, hovered over the skies of Aurora and Nueva Ecija for an aerial assessment of various natural hazards, to evaluate the safest rehabilitation site and resettlement area for the calamity-stricken residents of Aurora, a mission spearheaded by Senator Richard J. Gordon;

WHEREAS, “poor and simple,” as described by his family, RSP will always be the well-loved, eandearing and affectionate “Daddy”. The Punongbayans are proud to have the wealth of their father’s name, a legacy, untarnished by any season of life;

WHEREAS, the City Government and people of Olongapo join the Punongbayan Family in their moment of grief and pray that they will find solace in God’s mercy and comfort;

NOW, THEREFORE, with the unanimous accord of the members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to express, as it hereby expresses profound sorrow over the untimely demise of Philippine National Red Cross (PNRC) Governor and former Philippine Institute of Volcanology and Seismology (PHIVOLCS) Director, Dr. Raymundo S. Punongbayan and condoling with his bereaved family.

WHEREAS, the news about the passing away of Ms. Bella Dy Tan on April 26, 2005 has deeply saddened the people of Olongapo who knew her;

WHEREAS, Ms. Bella Dy Tan, daughter of James Dy, a true friend of Olongapo, was herself so outgoing in rendering gestures of friendship to this City that her memory will always abide with us;

WHEREAS, Olongapo City was the beneficiary of many gestures of friendship and assistance from Ms. Bella Dy Tan, such that she will always be remembered with fondness in this City;

WHEREAS, she was a fount of generosity every time that Olongapo City had festivities and celebrations, sharing with us her deep resource of entertainment possibilities, sending her own artists, singers and directors during our City Fiestas as well as Mardi Gras Celebrations;

WHEREAS, the passing away of Ms. Bella Dy Tan is very deeply felt with sorrow in the City of Olongapo;

A RESOLUTION APPROVING THE OPENING OF TWO(2) TRUST FUND
CHECKING ACCOUNTS WITH THE DEVELOPMENT BANK OF THE PHILIPPINES (DBP) SUBIC BAY BRANCH FOR THE UNITED NATIONS FUND FOR FAMILY PLANNING ACTIVITY (UNFPA) FINANCIAL ASSISTANCE TO THE CITY OF OLONGAPO ON THE IMPLEMENTATION OF THE UNFPA
6TH COUNTRY PROGRAMME

WHEREAS, the City of Olongapo is the only city chosen, among ten (10) provinces included, as one of the partners in the United Nations Family Planning Program Activity (UNFPA) 6th Country Programme Document;

WHEREAS, in connection with the abovesaid program, the City of Olongapo will be the recipient of $100,000.00 estimated cost of financial assistance per year for the next five years from the UNFPA;

WHEREAS, pursuant to the provisions of paragraph 13 and 14 of the Letter of Understanding between UNFPA and the City of Olongapo, there is a need for the City to open a checking account for the proper accounting and for monitoring of official bank transactions;

WHEREAS, the Development Bank of the Philippines (DBP) Subic Bay Branch was chosen as the official bank for this purpose;

WHEREAS, the official signatories, specifically on the withdrawals from the said checking accounts are hereby designated, to wit:

A RESOLUTION RATIFYING THE ADDENDUM TO THE CONTRACT OF JANITORIAL SERVICES DATED APRIL 1, 2005 ENTERED INTO BY AND BETWEEN THE CITY GOVERNMENT OF OLONGAPO AND SUBIC BAY WORKERS/VOLUNTEERS COOPERATIVE, INCORPORATED

WHEREAS, on June 16, 2004 the City Government of Olongapo and Subic Bay Workers/ Volunteers Multi-Purpose Cooperative, Inc entered into Contract of Janitorial Services:

WHEREAS, on June 18, 2004 the Sangguniang Panlungsod of Olongapo City enacted Resolution No. 87, Series of 2004 otherwise known as “A Resolution ratifying the Contract of Janitorial Services entered into by and between the Honorable City Mayor Katherine H. Gordon and Subic Bay Workers/Volunteers Multi-Purpose Cooperative, Inc. represented by Carmen Del Rosario, General Manager pertaining to the janitorial services at various city facilities.

WHEREAS, on April 1, 2005 an Addendum to the Contract of Janitorial Services has been entered into by and between the Subic Bay Workers/Volunteers Multi-Purpose Cooperative, Inc. and City Government of Olongapo.


WHEREAS, the Original Contract dated June 16, 2004 provides only for Eight (8) personnel:

WHEREAS, after careful evaluation of the job assigned to each personnel, services to be rendered as well as for the further maintenance of cleanliness on all areas of the Olongapo City Mall, it was deemed that the eight personnel shall be insufficient:

OF THE OLONGAPO CITY COMMERCIAL MALL

WHEREAS, the City of Olongapo is empowered to enter into contract by provision of Section 22 of Republic Act 7160 otherwise known as the Local Government Code of 1991;

WHEREAS, in the exercise of such power, the City Mayor has been given a continuing authority to enter into contracts with tenants of the Olongapo City Commercial Mall pursuant to Resolution No. 175, Series of 2003;

WHEREAS, on September 16, 2004, September 17, 2004 and February 1, 2005, the City Government of Olongapo has entered into contract of lease with My Kiddie Palace represented by its Manager Maureen Lim Santiago, RMH Trading represented by its proprietor Engr. Roseller M. Hilario and Green Cores Trading represented by its manager Sherrylyn A. Lanez, respectively;

WHEREAS, after a careful deliberation and discussion, the Contracts of Lease with tenants of the Olongapo City Commercial Mall has conformed to the requirements laid down under Article 1318 of the Civil Code;

NOW THEREFORE, on motion of Councilor Noel Y. Atienza, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to ratify, as it hereby ratifies the contracts entered into by and between the City Government of Olongapo and tenants of the Olongapo City Commercial Mall dated September 16, 2004, September 17, 2004 and February 1, 2005.

WHEREAS, upon gaining professional accomplishments in his own right, he devoted his life to philanthropic works, among them the consistent award of generous donations to the James L. Gordon Memorial Hospital in the form of equipment, supplies, medicines and the like;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to approve, as it hereby approves the Barangay Budget of Barangay New Kalalake, City of Olongapo for the Calendar Year 2005 considering that the budget as contained in Barangay Resolution No. 005, Series of 2005 of Barangay New Kalalake, upon review by the Sangguniang Panlungsod, has substantially complied with the requirements and limitation set forth under R.A. No. 7160 or the Local Government Code of 1991 and other pertinent issuances, circulars and memoranda with respect to Barangay Budgets: PROVIDED, that the City Accountant is enjoined to observe that the conditions enumerated by the City Budget Officer in his endorsement letter of March 29, 2005 on the matter which form an integral part of this Resolution are strictly complied with, and the requirements imposed by City Resolution No. 3, Series of 1996 are fully satisfied.

A RESOLUTION STRONGLY SUPPORTING SENATE BILL NO. 1402, OTHERWISE KNOWN AS, “AN ACT ESTABLISHING A COMPREHENSIVE JUVENILE JUSTICE SYSTEM AND DELINQUENCY PREVENTION PROGRAM, CREATING THE OFFICE OF THE JUVENILE JUSTICE AND DELINQUENCY PREVENTION UNDER THE DEPARTMENT OF JUSTICE, APPROPRIATING FUNDS THEREFOR AND FOR OTHER PURPOSES.”


WHEREAS, the presence of around 68,000 children in the country’s adult prison contributes greatly to the encumbrance of this society. Most of the said children are illegally detained for minor offenses, mere suspicion and are denied due process of law.

WHEREAS, these children experience the worst conditions in prison like starvation, physical and sexual abuses, diseases, as well as mental and physical breakdown.

WHEREAS, each and every Filipino should protect the children, being the future of the succeeding generations, that these children should be given equal opportunity for food, shelter, education and love of family along with the community, they deserve.

WHEREAS, the total of more than 1,500 local legislative bodies around the country should unite to change the present system and uplift the lives of these young members of our nation by supporting the proposal to establish a comprehensive juvenile justice system and delinquency prevention program.

NOW THEREFORE, on motion of Councilor Gina Gulanes Perez, with the unanimous accord of the members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED by the Sangguniang Panlungsod in session assembled, to approve, as it hereby approves A Resolution Strongly Supporting Senate Bill 1402, otherwise known as “An Act Establishing A Comprehensive Juvenile Justice System And Delinquency Prevention Program, Creating The Office Of Juvenile Justice And Delinquency Prevention Under The Department Of Justice, Appropriating Funds Therefore And For Other Purposes”.

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, that copies of this resolution be furnished to the Philippine Councilor’s League for their support and the Senate for their consideration.

WHEREAS, it has been observed that operators of public utility jeepneys, tricycles or buses employ more than one or two drivers to operate the said public utility vehicle in shifts. However, only one of them attends the defensive driving seminar as required by Ordinance No.7, Series of 2001;

WHEREAS, attending the defensive driving seminar for drivers is one requirement for the renewal of driver’s I.D as well as the issuance of I.D’s for new drivers to operate public utility vehicles;

NOW, THEREFORE, on motion of Councilor Cynthia G. Cajudo with the unanimous accord of the Members of the Sangguniang Panlungsod present,
