RESOLUTION NO. 55
(Series of 2005)

A RESOLUTION DECLARING AND RESERVING
ALL OPEN AND ACCRETION AREAS ALONG HALFMOON BEACH
AS ECO-TOURISM SITES OF THE CITY

WHEREAS, the turn over agreement entered into by and between the governments of the United States of America and the Philippines, explicitly provided that waters along Halfmoon Beach be open to the public for swimming and other recreational purposes;

WHEREAS, the City Government is working on and has made representations with the Department of Environment and Natural Resources (DENR) on the implementation of the said turn over agreement;

WHEREAS, over the years, accretion due to the natural course of nature happened to our beach areas including Halfmoon Beach which should be developed to its full potential to boost the growing tourism industry of the city;

WHEREAS, the DENR recommended the area as ideal site for eco-tourism;

NOW, THEREFORE, on motion of Councilor Teodoro D. Del Rosario, with the majority decision of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to declare and reserve, as it hereby declares and reserves all open and accretion areas along Halfmoon Beach as Eco-Tourism Sites of the City.

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, that a copy of the communication from the DENR USEC. Manuel Gerochi and the technical descriptions pertaining to the said matter be made as an integral part of this resolution.

RESOLVED FINALLY, AS IT IS HEREBY FINALLY RESOLVED, to furnish a copy of this resolution to the Office of the DENR for information and appropriate action.
