In the interest of public service and on motion of Councilor Cynthia G. Cajudo, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to enact the following Ordinance:


ORDINANCE NO. 35
(Series of 2005)

AN ORDINANCE CREATING AND ESTABLISHING GUIDELINES OF BIDS AND AWARDS COMMITTEE (BAC) TRUST ACCOUNT UNDER THE CITY TRUST FUND FOR THE PROCUREMENT OPERATIONS, ADMINISTRATION AND/OR MANAGEMENT OF THE BAC CITY GOVERNMENT OF OLONGAPO AND OTHER PURPOSES


BE IT ORDAINED, BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED, THAT:

SECTION 1. A trust account under the City Trust Fund be created and established for the procurement operations, administration and/or management of the Bids and Awards Committee (BAC), established thru Executive Order No. 32, Series of 2004 dated 3 Sept. 2004 pursuant to RA No. 9184, otherwise known as the “Government Procurement Reform Act, its Implementing Rules and Regulations, Part A (IRR-A) and Department of Budget and Management (DBM) Budget Circular No. 2004-5.

SECTION 2. The said creation includes funding sources, application/utilization as well as the implementing guidelines of the funds and annual budget of the BAC, where the details of which are embodied in the BAC Resolution No. 05-171 (B) Series of 2005, made as integral part of this Ordinance.

SECTION 3. This Ordinance shall take effect upon its approval.
