RESOLUTION NO. 12
(Series of 2004)

A RESOLUTION ADOPTING THE RECOMMENDATION OF THE BARANGAY GRIEVANCE BOARD (BGB) IN IMPOSING THE PENALTY OF SUSPENSION TO BARANGAY CAPTAIN DANILO S. FERNANDEZ
FOR A PERIOD OF THIRTY (30) DAYS


WHEREAS, the Sangguniang Panlungsod of Olongapo City passed Ordinance, No. 75-A, Series of 2002 to amend Ordinance No. 58, Series of 2002 entitled “An Ordinance Creating Barangay Grievance Board and Defining their Jurisdiction, Powers, and Duties;”

WHEREAS, the members of the Sangguniang Panlungsod upon in depth assessment of the Decision rendered by the Grievance Board affirmed “in toto” the decision rendered in Adm. Case No. 2003-05, entitled “VIOLETA SORIANO VS. BARANGAY CAPTAIN DANILO S. FERNANDEZ ;”

WHEREAS, the body deems it proper to adopt the decision rendered by the Barangay Grievance Board on April 12, 2004 on the aforesaid case;

NOW THEREFORE, on motion of Councilor Noel Y. Atienza, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to adopt, as it hereby adopts the recommendation of the Barangay Grievance Board (BGB) in imposing the penalty of suspension to Barangay Captain Danilo S. Fernandez for a period of thirty (30) days from receipt hereof.

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, that a copy of the said decision be made as an integral part of this Resolution.
