RESOLUTION NO. 76
(Series of 2004)

A RESOLUTION ADOPTING REPUBLIC ACT 9262 OTHERWISE KNOWN
AS “AN ACT DEFINING VIOLENCE AGAINST WOMEN AND THEIR CHILDREN, PROVIDING FOR PROTECTIVE MEASURES FOR VICTIMS, PRESCRIBING PENALTIES THEREFORE, AND FOR OTHER PURPOSES”


WHEREAS, the provisions of RA 9262 otherwise known as “An Act Defining Violence Against Women And Their Children, Providing For Protective Measures For Victims, Prescribing Penalties Therefore, And For Other Purposes” which seek to provide protective measures to protect the family and its members particularly women and children and institute policies, prescribe penalties to minimize if not totally eradicate domestic violence in keeping with the fundamental freedom guaranteed under the Constitution and the Provision of the Universal Declaration of Human Rights, the Convention on the Elimination of all Forms of Discrimination Against Women, Convention on the Rights of the Child and Other International Human Rights Instruments of which the Philippines is a party was enacted into law on February 2, 2004;

WHEREAS, in pursuit of the state’s policy of valuing human life and guaranteeing respect for individual rights, declares violence against women and children as a gross violation of human rights, degrading people and robbing them of their dignity. Hence, the said law explicitly outlines the policies, penalties and support mechanisms regarding victims of violence especially on women and children;

WHEREAS, the city recognizes and fully supports the cause of every person particularly women and children and unequivocally conforms to the state’s policy of valuing human life and dignity and the provisions of RA 9262;

NOW, THEREFORE, on motion of Councilor Bella P. Asuncion, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to adopt, as it hereby adopts Republic Act 9262 Otherwise Known As “An Act Defining Violence Against Women And Their Children, Providing For Protective Measures For Victims, Prescribing Penalties Therefore, And For Other Purposes”
