RESOLUTION NO. 71
(Series of 2005)

A RESOLUTION OPPOSING THE APPLICATION OF GV BROADCASTING SYSTEM, INC. FOR THE ISSUANCE OF A CERTIFICATE OF PUBLIC CONVENIENCE TO INSTALL, OPERATE AND MAINTAIN AN FM RADIO STATION IN OLONGAPO CITY

WHEREAS, there are three (3) FM Radio Stations (DWOK, DWSL, DWSB) operating in Olongapo City and there are also three (3) registered AM Radio Stations (DWGO, DWHL, with DZOR-inactive). Moreover, AM and FM signals from other parts of Luzon specially Metro Manila are spilling over to Olongapo City;

WHEREAS, with the application of GV Broadcasting to operate and maintain an FM station in the city, filed at the National Telecommunications Commission, it will become an additional radio station that will compete with the existing radio facilities servicing the city, who are now suffering the economic pinch due to high cost of operation, maintenance and the meager advertising market to depend on;

WHEREAS, the Committee on Telecommunications and Information Communication Technology conducted a committee hearing in order to get facts and came up with the official position on the matter;

WHEREAS, further, on the public hearing conducted at the Sangguniang Panlungsod for the said purpose, GV Broadcasting failed to present the pertinent feasibility study and technical specification that will allay the apprehension of financial peril on the part of the local radio stations in the city with the additional entry of another radio station;

WHEREAS, in the presentation of GV Broadcasting in the same hearing, they also failed to specify the exact site for the construction of their radio station and transmission tower in order for the City Council to determine if there will be violation to any existing City Ordinance;

WHEREAS, while the city appreciates the good intention of GV Broadcasting to set up a radio broadcasting station in the city, the City Government of Olongapo is constrained to oppose the application at this time due to its financial viability which would negatively affect even the existing radio stations and lack of necessary data for the council to arrive at intelligent decision. However, this does not prevent them from submitting another application in the future when the state of over-all business situation becomes conducive to accepting additional radio stations in the city and all required documents are ready for presentation;

NOW, THEREFORE, on motion of Councilor Edwin J. Piano, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to oppose, as it hereby opposes the Application of GV Broadcasting System, Inc. for the Issuance of a Certificate of Public Convenience to Install, Operate and Maintain FM Radio Station in Olongapo City.

Let copies of this Resolution be furnished the National Telecommunications Commissions and the GV Broadcasting System, Inc. for their information and record.
