RESOLUTION NO. 35
(Series of 2005)

A RESOLUTION GRANTING AUTHORITY TO HONORABLE JAMES GORDON, JR. TO ENTER INTO A MEMORANDUM OF AGREEMENT WITH JOHNNY FOO FOR THE TEMPORARY OPERATION AND MAINTENANCE OF A COCKPIT ARENA SUITABLE FOR THE PURPOSE


WHEREAS, under the Republic Act (RA) 7160 otherwise known as Local Government Code of 1991, it is provided, that --

SEC. 458 – Powers, Duties, Functions and Compensation. – (a) The sangguniang panlungsod, as the legislative body of the city, shall enact ordinances, approve resolutions and appropriate funds for the general welfare of the city and its inhabitants pursuant to Section 16 of this Code and in the proper exercise of the corporate powers of the city as provided for under Section 22 of this Code, and shall:

(3) Subject to the provisions of Book II of this Code, enact ordinances granting franchises and authorizing the issuance of permits or licenses, upon such conditions and for such purposes intended to promote the general welfare of the inhabitants of the city and pursuant to this legislative authority shall:

(v) Any law to the contrary notwithstanding, authorize and license the establishment, operation, and maintenance of cockpits and regulate cockfighting and commercial breeding of gamecocks; Provided, That existing rights should not be prejudiced; x x x

WHEREAS, the City is positioning itself as a prime tourist and investor destination where indigenous diversion and amusement is of utmost consideration;

WHEREAS, the Sangguniang Panlungsod deems it beneficial for the City – for purposes of income generation and as an additional tourist attraction, at least for the duration of the summer season – to allow the operation and maintenance of a cockpit arena suitable for the purpose;

WHEREAS, Johnny Foo, a noted and well-known businessman, has expressed his consent and willingness to operate and maintain the same, at no extra cost to the City and subject to the payment of all necessary fees and taxes;

NOW, THEREFORE, on motion of Councilor Teodoro D. del Rosario, co-sponsored by Councilors Edwin J. Piano, Bella P. Asuncion and Noel Y. Atienza, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to grant, as it hereby grants authority to Honorable James Gordon, Jr., to enter into a Memorandum of Agreement with Johnny Foo for the temporary operation and maintenance of a cockpit arena suitable for the purpose.

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, that a copy of the Sta. Rita Barangay Council Resolution regarding the said matter be made an integral part of this Resolution.
