RESOLUTION NO. 54

A RESOLUTION RECOMMENDING TO THE CITY MAYOR THROUGH THE CITY ASSESSOR’S OFFICE THE ISSUANCE OF TAX DECLARATION UPON PAYMENT OF REAL ESTATE TAXES IN FAVOR OF MR. JEOFFREY SUMBAD AND OTHER PERSONS SIMILARLY SITUATED


WHEREAS, referred to the Committee on Laws, Complaints, Investigations and Human Rights Protection the Letter-Request dated July 9, 2004 of Mr. Jeoffrey Sumbad for a dialogue with the Office of the City Mayor concerning the claim of the City Planning Development Office that Lot Nos. 2254, 2255 and other adjoining owners covered and within area of Lot 568 being leased by the Subicwater;

WHEREAS, prior to the Letter-Request dated July 9, 2004 of Mr. Jeoffrey Sumbad, the latter has made a Letter-Application for the issuance of tax declaration for Lot 2254 covered by CNI Subdivision Map, New Cabalan, Olongapo City, the approval of the said application for issuance of tax declaration was held in abeyance until after the CNI Subdivision map in the possession of the City Planning and Development Office and that of in the possession of Mr. Jeoffrey Sumbad have been reconciled by requesting the Department of Environment and Natural Resources for official approved copy of the CNI Subdivision map;

WHEREAS, on July 16, 2004, the Committee on Laws, Complaints, Investigations and Human Rights Protection conducted a committee hearing which was attended by Oscar Agustin, City Assessor, and Elmer A. Mercado, Assessor’s Office, Jeoffrey Sumbad, Frank De Lara, CENRO, Richie Morelos and Romeo Ramos, Subicwater, Corazon Baldun, School Employee, Dave Contreras and Kgd. Edwin J. Piano, City Council, Nestor Delgado, DENR, Elizabeth Zavalla, Lynette dela Cruz and Joanne Agaton, CPDO and Leonardo Miano, City Legal Office;

WHEREAS, thereafter the said committee hearing where both contending parties were given the chance to air their respective contention and presented two different CNI Subdivision Maps, notably the one presented by the City Planning & Development Office bears no signature of the approving authority and on the other hand, the one presented by Mr. Jeoffrey Sumbad bears the signature of the approving authority albeit claim of the City Planning & Development Office that the CNI Subdivision Map in their possession has been made the basis for titling purposes;

WHEREAS, without even going over the other documents submitted by the parties, the CNI Subdivision Map in the possession of Mr. Jeoffrey Sumbad should be given great weight in the light of the approval of the approving authorities considering further Eng’r. Elmer M. Mercado of the City Assessor Office has recommended that a tax declaration be issued for Lot 568 with more reason that taxes on Lot No. 2254 be likewise paid and tax declaration be issued in favor of Jeoffrey Sumbad;

NOW, THEREFORE, on motion of Councilor Noel Y. Atienza, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to recommend, as it hereby recommends to the City Mayor through the City Assessor’s Office the issuance of Tax Declaration upon payment of Real Estate Taxes in favor of Mr. Jeoffrey Sumbad and other persons similarly situated.
