RESOLUTION NO. 61
(Series of 2004)

A RESOLUTION ADOPTING THE DECISION DATED NOVEMBER 17, 2004 FINDING RESPONDENT DANILO FERNANDEZ GUILTY OF GROSS NEGLIGENCE AND SUSPENDING BARANGAY CAPTAIN DANILO FERNANDEZ FOR A PERIOD OF ONE (1) MONTH FROM OFFICE (ADM CASE NO. 08-30-04) FOR WITHHOLDING OF HONORARIUM OF MEMBERS OF THE LUPON TAGAPAMAYAPA

WHEREAS, on the August 30, 2004, a complaint was filed by Edgardo Danugrao and members of the Lupon Tagapamayapa against respondent Danilo Fernandez;

WHEREAS, the respondent submitted his counter-affidavit on September 27, 2004 and thereafter the parties were given the opportunity to present their witnesses on September 28 and October 5, 2004 respectively, and thereafter the case is deemed submitted for decision;

WHEREAS, after a careful deliberation and study of the facts of the case taking into account the parties’ respective witnesses and documentary evidence, the committee as a whole has rendered finding the respondent guilty of gross negligence from the withholding of the honorarium of the members of Lupon Tagapamayapa and suspending him for period of one (1) month from office;

WHEREAS, the Sangguniang Panglungsod in a session assembled unanimously approved to adopt the said decision and made the same as an integral part of this Resolution.

NOW, THEREFORE, with the unanimous accord of Members of the Sangguniang Panglungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to adopt, as it hereby adopts the decision dated November 17, 2004 finding the respondent Danilo Fernandez guilty of gross negligence and suspending him from office for a period of one (1) month from receipt thereof.
