BE IT ORDAINED, BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED, THAT:

SECTION 1. The amount of Eighteen Million Five Hundred Fifty Eight Thousand Two Hundred Seventy Two Pesos and 84/100 (Php18,558,272.84) is hereby appropriated from the General Fund and Ten Million Pesos (PhP10,000,000.00) chargeable to the PAGCOR FUND for various infrastructure projects in Olongapo City to wit:

RESOLUTION NO. 04

A RESOLUTION COMMENDING DR. ELLADORA MOLINA
FOR SERVING AS RURAL HEALTH PHYSICIAN I FOR 35 PRODUCTIVE YEARS AT THE CITY HEALTH DEPARTMENT


WHEREAS, with the great demand for medical health practitioners in the rural health areas in the country, it is truly heroic for a rural health physician to have chosen to render ones service in this field meagerly compensated as compared with the lucrative life one may achieve from a successful private practice;

WHEREAS, Dr. Elladora Molina, a rural health physician at the City Health Department has sincerely dedicated her time and effort doing medical services in the community particularly at Barangays Kalalake and Asinan, and has actively participated in several outreach programs/medical missions of the City;

WHEREAS, upon her retirement in government service after 35 years of public service commitment, still seeks to direct her expertise to continually respond to the needy through her involvement as an active member of several religious society and civic organizations such as the San Lorenzo Parish Church, Legion of Mary Immaculate and the Olongapo City Medical Society;

NOW, THEREFORE, on motion of Councilor Angelina B. Andrada, with the unanimous accord of the members of the Sangguniang Panlungsod present,

RESOLUTION NO. 02
(Series of 2005)

A RESOLUTION APPROVING THE CONSTRUCTION OF THE RETAINING WALL AT THE ENGINEERING MOTORPOOL (TRANSCON)


WHEREAS, the City had recently approved the list of priority infrastructure projects to be funded by receivables from Subicwater and Sewerage Company;

WHEREAS, however, in a letter by the City Mayor, Honorable James Gordon Jr., dated January 10, 2005, the said list was amended. The source of funding thereof shall be from General and PAGCOR Funds instead since funds from Subicwater has not been forwarded to the City;

WHEREAS, one of the projects covered by the said amendment is the construction of the retaining wall at the Engineering Motorpool (Transcon) which will amount to Php1,243,158.23 under the General Fund;

NOW, THEREFORE, on motion of Councilor Anselmo A. Aquino, with the unanimous accord of the members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to approve, as it hereby approves the construction of the retaining wall at the Engineering Motorpool (Transcon).

A RESOLUTION AUTHORIZING THE PHILIPPINE NATIONAL POLICE (PNP) OFFICER UNDER ORLANDO M. MADDELA, JR., POLICE SENIOR SUPERINTENDENT, CITY DIRECTOR, OLONGAPO CITY POLICE OFFICE TO CAUSE THE SERVICE OF THE DECISION PROMULGATED BY THE SANGGUNIANG PANLUNGSOD OLONGAPO CITY DATED NOVEMBER 17, 2004 TO RESPONDENT BARANGAY CAPTAIN DANILO S. FERNANDEZ PURSUANT TO DILG OPINION NO. 6, SERIES OF 1998

WHEREAS, on November 17, 2004, the Sangguniang Panlungsod of Olongapo City in the exercise of quasi-judicial power and after due trial and deliberation rendered a decision finding respondent Barangay Captain Danilo S. Fernandez guilty of gross negligence and suspending the latter from office for a period of one (1) month upon receipt thereof;

WHEREAS, the said decision was adopted by the Sangguniang Panlungsod through Resolution No. 61, Series of 2004 and formally indorsed to the City Mayor for his approval;

WHEREAS, on December 10, 2004, Hon. James J. Gordon, Jr., City Mayor through Atty. Manuel Quijano, City Administrator returned Resolution No. 61, Series of 2004 otherwise known as “A resolution adopting the decision dated November 17, 2004 finding respondent Danilo S. Fernandez guilty of gross negligence and suspending Barangay Captain Danilo S. Fernandez for a period of one (1) month from office” to Hon. Rolen C. Paulino, City Vice Mayor of Olongapo and formally requested the Office of the Department of Interior and Local Government for a legal opinion;

WHEREAS, on December 15, 2004, Atty. Manuel Quijano forwarded to the Hon. Rolen C. Paulino, City Vice Mayor, Olongapo City the letter dated December 10, 2004 of Ms. Josefina Castillo-Go, CESO III, Regional Director, DILG, City of San Fernando, Pampanga;

WHEREAS, as per the Letter dated December 10, 2004 of Ms. Josefina Castilla-Go, CESO III, Regional Director, DILG, City of San Fernando, Pampanga states that the exclusive power to hear and decide administrative cases against barangay elective official are vested with the Sangguniang Panlungsod and it follows that the same need not be approved by the Local Chief Executive;

WHEREAS, the body agreed that all subsequent decision promulgated by the Sangguniang Panlungsod as a quasi-judicial body shall be served by the aforementioned office;

NOW, THEREFORE, on motion of Councilor Noel Y. Atienza, with the unanimous accord of the members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to authorize, as it hereby authorizes the Philippine National Police (PNP) Officer under Orlando M. Maddela, Jr., Police Senior Superintendent, City Director, Olongapo City Police Office to cause the service of the decision promulgated by the Sangguniang Panlungsod Olongapo City dated November 17, 2004 to respondent Barangay Captain Danilo S. Fernandez pursuant to DILG Opinion No. 6, Series of 1998.

ENGR. REYMUNDO S. GUEVARA, AS CITY GOVERNMENT DEPARTMENT HEAD II (CITY ENGINEER), SG-26, UNDER THE ENGINEER DEPARTMENT


WHEREAS, the City Mayor has appointed Engr. Reymundo S. Guevara as City Department Head II, City Engineer pursuant to Civil Service Laws, Rules and Regulations;

WHEREAS, Section 454(d) of Republic Act 7160, otherwise known as the Local Government Code of 1991, provides that heads of departments shall be appointed by the City Mayor with the concurrence of the majority of all Members of the Sangguniang Panlungsod;

NOW, THEREFORE, on motion of Councilor Gina G. Perez, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to confirm, as it hereby confirms the appointment of ENGR. REYMUNDO S. A RESOLUTION ADOPTING REPUBLIC ACT 9262 OTHERWISE KNOWN
AS “AN ACT DEFINING VIOLENCE AGAINST WOMEN AND THEIR CHILDREN, PROVIDING FOR PROTECTIVE MEASURES FOR VICTIMS, PRESCRIBING PENALTIES THEREFORE, AND FOR OTHER PURPOSES”


WHEREAS, the provisions of RA 9262 otherwise known as “An Act Defining Violence Against Women And Their Children, Providing For Protective Measures For Victims, Prescribing Penalties Therefore, And For Other Purposes” which seek to provide protective measures to protect the family and its members particularly women and children and institute policies, prescribe penalties to minimize if not totally eradicate domestic violence in keeping with the fundamental freedom guaranteed under the Constitution and the Provision of the Universal Declaration of Human Rights, the Convention on the Elimination of all Forms of Discrimination Against Women, Convention on the Rights of the Child and Other International Human Rights Instruments of which the Philippines is a party was enacted into law on February 2, 2004;

WHEREAS, in pursuit of the state’s policy of valuing human life and guaranteeing respect for individual rights, declares violence against women and children as a gross violation of human rights, degrading people and robbing them of their dignity. Hence, the said law explicitly outlines the policies, penalties and support mechanisms regarding victims of violence especially on women and children;

WHEREAS, the city recognizes and fully supports the cause of every person particularly women and children and unequivocally conforms to the state’s policy of valuing human life and dignity and the provisions of RA 9262;

NOW, THEREFORE, on motion of Councilor Bella P. Asuncion, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

THE CITY GOVERNMENTS’ COLLECTION OF RECEIVABLES
FROM SUBICWATER


WHEREAS, the City puts in place necessary infrastructure projects in different barangays of the City to match the needs of the community and serve as framework to sustain upcoming programs. All projects in the list are deemed as worthy of project implementation;

NOW, THEREFORE, on joint motion of Councilors Anselmo A. Aquino, Teodoro D. Del Rosario and Edwin J. Piano with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to approve, as it hereby approves the implementation Of City Priority Projects Amounting To Twenty Seven Million Three Hundred Fifteen Thousand One Hundred Fourteen Pesos And 61/100 (Php27,315,114.61), funding of which will be sourced from the City Governments’ collection of receivables from Subicwater;

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, that copy of the aforesaid projects be made as an integral part of this Resolution.

A RESOLUTION COMMENDING MS. ISABEL O. TRINIDAD, MS. REMEDIOS T. GALLOSA, MR. INOCENCIO B. DANTAY AND MR. MARIANO T. SULANGI FOR THEIR INVALUABLE CONTRIBUTIONS IN THE FIELD OF EDUCATION

WHEREAS, Ms. Isabel O. Trinidad, Department of Education Supervisor on Homemaking and Family Values who retired last October 7, 2004 marked a 38-year dedicated service in the field. Her dynamic influence in the lives of her students attest of her rich legacy as a fulfilled educator;

WHEREAS, Ms. Remedios T. Gallosa, Mathematics Coordinator and Elementary School Principal, exemplified the true image of a good teacher. Her 41 years of service and the various awards garnered by the City in the scope of mathematics are the rich fruits of her leadership;

WHEREAS, Education Supervisor Mr. Inocencio B. Dantay, inked 41 years of service as an outstanding instructor in the field of Music and Communications. He was indeed instrumental in the molding of gifted students in achieving numerous accolades, to the City’s pride;

WHEREAS, Mr. Mariano T. Sulangi, Cashier II at the City Schools Division of the Department of Education provided adequate support in the functions of its accounting and auditing section. He remained faithful in his task for 23 long years, which enabled the entire department achieve its goals;

WHEREAS, the City commends the exemplary performance and dedication they have rendered in educating the younger populace of the City and wishes that their retirement will be a sojourn for another yet exciting arena of accomplishment;

HONORABLE TEODORO D. DEL ROSARIO AND MR. JOHNNY FOO FOR THE CONSTRUCTION AND OPERATION OF A MULTI-PURPOSE COCKPIT ARENA


WHEREAS, on November 17, 2004 in a Regular Session of the Sangguniang Panlungsod, Olongapo City, a Resolution ratifying the Memorandum of Agreement between the Olongapo City Fiesta Committee 2004 represented by its Chairman, Honorable Teodoro D. del Rosario and Mr. Johnny Foo for the construction and operation of a Multi-Purpose Cockpit Arena has been passed on first, second and final reading;

WHEREAS, after careful deliberation, a supplemental contract has been entered into between the Olongapo City Fiesta Committee 2004 and Johnny Foo for the construction and operation of a multi-purpose cockpit arena with supplemental/addendum made as an integral part of it;

WHEREAS, the same has been referred to the Committee on Laws for study and recommendation;

WHEREAS, after the said assessment, the addendum was deemed to comply with all the requisites of a valid contract under Article 1318 of the Civil Code of the Philippines which states among others:

“ There is no contract unless the following requisites concur:
(1) Consent of the contracting parties:
(2) Object certain which is the subject matter of the contract;
(3) Cause of the obligation which is established.(1261) ”

WHEREAS, the City Government of Olongapo through then City Mayor Katherine H. Gordon and Club Tourism International, Inc. represented by Chairman Hideo Takashi entered into a Memorandum of Agreement for the implementation of the “Caregivers’ Project” at the Gordon College;

WHEREAS, considering the fertile opportunity of the caregiver market in Japan, the said project endeavors to teach the Japanese language and culture to caregiver students of Gordon College, improve their communication skills and understanding of Japanese retirees;

WHEREAS, Sensei Kazue Abe and Sensei Yoshiko Inagaki are two of the volunteer Japanese teachers who diligently taught the students the Japanese language as well as its culture and extended their teaching services as well to a number of government employees;

WHEREAS, the City Government and the people of Olongapo acknowledge their contributions and service to the said undertaking which indeed fostered friendship and goodwill;

A RESOLUTION CREATING A TRUST FUND ACCOUNT UNDER THE NAME ROAD FUND DISBURSEMENT ACCOUNT FOR THE CITY’S SHARE
IN THE COLLECTION OF ROAD USER’S TAXES
PURSUANT TO REPUBLIC ACT 8794


WHEREAS, Republic Act 8794, otherwise known as the “Motor Vehicle User’s Charges”, provides provinces and cities five percent (5%) share in the collections of road user’s taxes, the same to be distributed on the basis of the size of roadside works and vehicle population in each province and city;

WHEREAS, Olongapo City received a cogent information that the City is one of the fifty (50) cities whose work program for the utilization of Special Local Roads Funds (SLRF) had been approved by the Road Board for funding;

WHEREAS, pursuant to the implementing Rules and Regulations of the said Act, the City was advised to open a separate trust account under the name Road Fund Disbursement Account from which the 2004 share as well as subsequent shares of the road fund shall be deposited;

WHEREAS, the City deems that it is in the best interest of the City that such account be opened for and in behalf of the City;

NOW, THEREFORE, on motion of Councilor Edwin J. Piano, with the unanimous accord of the Members of the Sanggniang Panlungsod present,

WHEREAS, Proclamation No. 109 designates the period November 24-30 as National Book Week. To adopt the said celebration, the City passed Resolution No. 57, Series of 2004;

WHEREAS, the event was celebrated with fun filled activities such as treasure hunting, painting and poster making contest, presented an acoustic night, free blood typing, free clinic and storytelling;

WHEREAS, through the generous assistance and support of some organizations and individuals, the City, which is under a state of financial crisis, would have not been possible to conduct the Book Week celebration with such festive mood;

NOW, THEREFORE, on joint motion of Councilors Marey Beth D. Marzan and Brian Patrick H. Gordon, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to express, as it hereby expresses gratitude and appreciation to the following organizations and individuals: Jollibee Food Corporation, Greenwich, Accord Bank, Columban College Elementary Department, Mondriaan Aura College, Olongapo City Medical Society, Department of Education, Department of Trade and Industry, National Census Office, IDESS Maritime Services, RJ Merchandise, Sammy’s General Services, Mr. Manolo R. Silayan, Ms. Linda Lim, Dr. Leilani Asis, Dr. Nancy Mendoza, Ms. Lina Salas, Ms. Josefina Legaspi, Ms. Grace Abad and Mr. Roberto J. (Series of 2004)

A RESOLUTION OF COMMENDATION ON THE DISTINGUISHED CONTRIBUTIONS OF MS. ANGELITA R. LACUESTA IN THE CITY

WHEREAS, Ms. Angelita R. Lacuesta, Education Supervisor I for Physical Education and Sports is due to retire on December 22, 2004 leaving an indelible mark of 41 years of service in the field of education;

WHEREAS, along with her wholehearted dedication, Ms. Lacuesta fused efficiency, skill and talent as she garnered various awards of excellence as Outstanding Physical Education Teacher in 1980, Outstanding Woman Educator in Olongapo in 1998 and Outstanding Division Education Supervisor I in 2003;

WHEREAS, her contagious positive attitude, enthusiasm, hardwork and excellent track record earned her the trust of the City Government to spearhead the hosting of the 2004 Central Luzon Regional Athletic Association (CLRAA) Meet where the City stamped fourth out of the fifteen competing divisions in the entire Central Luzon;

WHEREAS, together with the Committee, Ms. Lacuesta conquered the litany of challenges that went with the hosting preparations. As such, the heartwarming welcome program which presented the rich and vibrant culture of Olongapo, comfortable accommodations, unmatched peace and order and superb hospitality were products of her hands-on leadership;

WHEREAS, indeed, the success of the said event scaled the peak of her accomplishment as Education Supervisor, an achievement honed from innumerable classroom experiences, district competitions and other programs where she instilled moral discipline and spurred the creative development of her students;

WHEREAS, the City stands privileged to have been served by a model teacher, faithful friend and competent leader exemplified by Ms. Lacuesta. For this, her retirement serves as an encore in pursuing greater strides in other fields of endeavor;

NOW THEREFORE, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to commend, as it hereby commends the distinguished contributions of Ms. Angelita R. Lacuesta in the City.

A RESOLUTION AUTHORIZING CITY MAYOR, HONORABLE JAMES GORDON, JR. TO ENTER INTO A CONTRACT FOR AND IN BEHALF OF OLONGAPO CITY WITH BAYAN TELECOMMUNICATIONS INCORPORATED (BAYANTEL) REGARDING INTERNET ACCESS
AND DIGITAL SUBSCRIBER LINES (DSL) AND
LIKEWISE RATIFYING THE SAME


WHEREAS, Bayan Telecommunications Incorporated (BayanTel) is one of the country’s leading provider of data and communications services such as dedicated domestic and international leased lines, frame relay services, internet access and other managed data services like the Digital Subscriber Lines (DSL);


WHEREAS, with BayanTel’s strengthened capability to provide a full range of Internet services to customers, including co-location, e-mail hosting, web-hosting and firewalls and all the time fast and reliable connectivity, the City deems it best that availing the said internet access and digital subscriber lines of BayanTel will complement its thrusts in providing excellent services to its constituents;


NOW THEREFORE, on motion of Councilor Noel Y. Atienza, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to authorize, as it hereby authorizes City Mayor. Honorable James Gordon Jr., to enter into a contract for and in behalf of Olongapo City with Bayan Telecommunications Incorporated (BayanTel) regarding internet access and digital subscriber lines (DSL).

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, that the said signed contract be ratified to pave way for its implementation.

RESOLVED FINALLY, AS IT IS HEREBY FINALLY RESOLVED, that a copy of the said contract be made as an integral part of this Resolution.

A RESOLUTION RATIFYING THE MEMORANDUM OF AGREEMENT (MOA) ENTERED INTO BY AND BETWEEN THE OLONGAPO CITY FIESTA COMMITTEE, REPRESENTED BY ITS CHAIRMAN, HON. TEODORO D. DEL ROSARIO AND
MR. JOHNNY FOO PERTAINING TO THE OPERATION OF A MULTI-PURPOSE COCKPIT ARENA IN THE CITY
OF OLONGAPO

WHEREAS, the City Government tasked this year’s City Fiesta Committee to conceptualize, plan and implement programs that will invigorate the fiesta celebration, encourage maximum participation from all sectors of society and raise funds for the City’s developmental projects;

WHEREAS, through the said Committee, fund raising endeavors that are uniquely innovative have been assessed as worthy of implementation as they target various markets;

WHEREAS, the Fiesta Committee, through its Chairman, Hon. Teodoro D. del Rosario entered into a Memorandum of Agreement with Mr. Johnny Foo for the establishment and operation of a multi-purpose cockpit arena from November 16, 2004 to February 16, 2005;

WHEREAS, the said fundraising venture under the City Fiesta Committee is considered as one of the potent strategies in raising funds for City projects;

NOW, THEREFORE, on motion of Councilor Noel Y. Atienza, with the unanimous accord of the Members of the Sangguniang Panlungsod present,
